NOTICE OF FORFEITURE OF OIL AND GAS LEASES
To Hanley and Bird, a partnership, J.W. Bird, and William Hanley, their successors or assigns (the "Lessees"):
Gary L. Teeter, Trustee of the Gary L. Teeter Revocable Trust dated August 2, 2011, and Image Incorporated (collectively, the "Owner") owns the oil, gas, and other minerals in and underlying approximately 161.95 acres, more or less, of real property located in Section 22 of Canton Township, Stark County, Ohio, being Parcel Nos. 1308732, 1301197, and 1301198 (the "Property"), and more fully described in Stark County Instrument Nos. 201110310043496 and 201212070056261.
On November 1, 1943, Oscar J. Singer and Ella H. Singer (the original lessor and Owner's predecessor-in-interest) leased a portion of the Property to the East Ohio Gas Company in an oil and gas lease recorded February 24, 1944, in Stark County Lease Records Volume 74, Page 224 (the "First Singer Lease"). On December 10, 1945, The East Ohio Gas Company assigned all its right, title and interest in the First Singer Lease to J.W. Bird and William Hanley Heirs, d.b.a. Hanley and Bird, a partnership, in an Assignment recorded April 12, 1946, in Assignment Volume 6, Page 312. Pursuant to the public land records of Stark County, Ohio, the Lessees are either the original assignees under the First Singer Lease, or the successors to J.W. Bird and William Hanley Heirs, d.b.a. Hanley and Bird.
On October 26, 1946, Oscar J. Singer and Ella H. Singer (the original lessor and Owner's predecessor-in-interest) leased a portion of the Property to Hanley and Bird, a partnership, in an oil and gas lease recorded November 18, 1946, in Stark County Lease Records Volume 85, Page 245 (the "Second Singer Lease"). Pursuant to the public land records of Stark County, Ohio, the Lessees are either the original lessee under the Second Singer Lease or the successors to Hanley and Bird.
Pursuant to Section 5301.332 of the Ohio Revised Code, Lessees, as successors to Hanley and Bird, their successors and assigns, are hereby notified that there are no producing wells drilled under the terms of the First Singer Lease and/or the Second Singer Lease (the "Leases"), no operations for oil or gas being conducted on any of the lands covered by the Leases under the terms of the Leases, and no other provision holds the Leases beyond its primary term. Therefore, the Leases are forfeited, terminated, or has otherwise expired by its own terms. The Owner is not now, nor have they ever, received rents or royalties from production under the Leases, and the Owner would refuse to accept payment of rentals or royalties under the Leases if they were offered. The Owner considers the Leases to be forfeited and void.
It is the intention of the Owner to file for record an Affidavit of Forfeiture in the public land records of Stark County, Ohio, pursuant to Ohio Revised Code Section 5301.332 if Lessees, their respective successors or assigns, do not have the Leases released of record within thirty (30) days of receipt of this Notice or, if service cannot be completed by certified mail, thirty (30) days from the date of the publication of this Notice.
