NOTICE OF FORFEITURE OF REAL ESTATE CONTRACT
TO: Anastasia Crist, 5135 Cypress Drive, Pleasant Hill, IA 50327 and Preston Crist, 5135 Cypress Drive, Pleasant Hill, IA 50327
You and each of you are hereby notified:
1. The written contract dated September 13, 2024, and executed by Clearview Property, LLC and Clearview Property, LLC as vendors, and Anastasia Crist and Preston Crist as vendees, recorded on September 17, 2024; in the office of the Polk County Recorder, recorded as document reference number 2024-00048081, for the sale of the following described real estate:
Lot 18 in Southridge Park Plat 5, an Official Plat now included in and forming a part of the City of Pleasant Hill, Polk County, Iowa.
has not been complied with in the following particulars:
a) Failure to make May 2026 payment 2,209.81
b) Failure to make April 2026 payment 2,209.81
c) Failure to make March 2026 payment 2,209.81
d) Failure to make February 2026 payment 2,209.81
e) Failure to make January 2026 payment 2,209.81
f) Failure to make December 2025 payment 2,209.81
g) Failure to make November 2025 payment 2,209.81
h) Failure to make October 2025 payment 2,209.81
i) Failure to make September 2025 payment 2,209.81
j) Failure to make August 2025 payment 2,209.81
k) Only made partial payment for July 2025 payment 742.62
Total $22,840.72
2. The contract shall stand forfeited unless the parties in default, within 30 days after the completed service of this notice, shall perform the terms and conditions in default, and in addition pay the reasonable costs of serving this notice.
3. The amount of attorney fees claimed by the Vendors pursuant to Section 656.7 of the Code of Iowa is $50.00 (not to exceed $50.00). Payment of the attorney fees is not required to comply with this notice in order to prevent forfeiture.
