NOTICE OF HEARING STATE OF GEORGIA CHATHAM COUNTY NOTICE OF HEARING Notice to the public is hereby given that on October 20, 2025, at 8:30 a.m., in the Superior Court of Chatham County, at the courthouse in said county, a hearing will be held in the case of State of Georgia v. City of Tybee Island Building and Public Facilities Authority and City of Tybee Island, Georgia, on the petition and complaint to validate the CITY OF TYBEE ISLAND BUILDING AND PUBLIC FACILITIES AUTHORITY REVENUE BOND (FIRE STATION PROJECT), SERIES 2025 (the "Series 2025 Bond"), in the principal amount of $2,480,000, which is authorized to be issued by a Bond Resolution, adopted on September 25, 2025, by vote of a majority of the members of the City of Tybee Island Building and Public Facilities Authority (the "Authority"). Proceeds from the sale of the Series 2025 Bond will be used by the City of Tybee Island, Georgia (the "City") to provide funds for the acquisition of real property for the construction and equipping of a new fire station complex. The Court will also adjudicate the valid and binding effect of the form of a Lease between the Authority and the City under which the City shall agree to make certain rental payments for the account of the Authority, which payments are pledged as security for the payment of the Series 2025 Bond sought to be validated. Pursuant to Section 36-82-100 of the Official Code of Georgia Annotated, certain issuers of revenue or general obligation bonds issued on or after May 5, 2006, are required to provide for a continuing performance audit or performance review of the expenditure of bond proceeds absent the publication of a notice expressly stating that no performance audit or performance review shall be conducted with respect to the bond issue. No performance audit or review shall be conducted with respect to the Series 2025 Bond. The financial statements of the City are audited annually and are subject to public inspection and review. At said hearing all persons having a right to be heard with respect to the Series 2025 Bond and the security provided therefor, and with respect to the validation thereof, may be heard.
