NOTICE OF JUDICIAL FORECLOSURE
Under and by virtue of O.C.G.A. 44-3-232, the Amended and Restated Declaration of Covenants, Conditions and Restrictions for Village at Autumn Lake recorded on December 11, 2020 in Deed Book 2166, Page 71, Chatham County Records, as amended (the "Declaration"), and by virtue of the Default Judgment and Order of Judicial Foreclosure entered on October 27, 2025, in the civil action Village at Autumn Lake Homeowners Association, Inc., Plaintiff v. Micheal C. Bradshaw, Defendant, Superior Court of Chatham County, Georgia, Case No. SPCV25-00672-KA, there will be sold by the Chatham County Sheriff's Office at public outcry to the highest and best bidder for cash, between the legal hours of sale, before the door of the Chatham County Courthouse in Chatham County, Georgia, on January 6, 2026, which is the first (1st) Tuesday of January, 2026, the following described property:
All that certain Lot, tract or parcel of land situate, lying and being known as Lot 109-A, THE VILLAGE AT AUTUMN LAKE SUBDIVISION, PHASE III as more particularly described on that certain Subdivision Map prepared for Autumn Lake Development Co., LLC by Thomas & Hutton Engineering Co, being recorded in the Office of the Clerk of Superior Court of Chatham County, Georgia in Subdivision Map Book 50, Pages 215 & 216. Reference is made to said plat for a more particular description of said property.
Together with improvements thereon more commonly known as 82 Harvest Moon Drive, Savannah, Georgia 31419 and bearing a Tax Parcel Number of 1-1008H-08-011.
(Hereinafter referred to as the "Property").
The debt secured by Village at Autumn Lake Homeowners Association, Inc. ("Plaintiff") lien, which totals $8,828.15 through October 27, 2025, plus any applicable advertisement fees, costs, and interest accrued after entry, has been and is hereby declared due because of failure to pay the indebtedness as and when due and in the manner provided for in the Declaration. Assessments, reasonable attorney's fees actually incurred, costs, and interest continue to accrue and are also secured by the Plaintiff's lien. The debt remaining in default, this sale will be made for the purpose of paying same and all expenses of the sale, as provided in the Georgia Property Owners' Association Act, O.C.G.A. § 44-3-220, et seq., and the Declaration (notice of attempt to collect attorney's fees having been given). The excess, if any, will be distributed to the person or persons legally entitled thereto.
To the best knowledge and belief of the undersigned, the party in possession of the subject Property is Micheal C. Bradshaw (aka Michael C. Bradshaw) or a tenant or tenants claiming through him.
The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the United States Bankruptcy Code, and (2) final confirmation and audit of the status of the lien with the holder of the Order of Judicial Foreclosure pursuant to the Georgia Property Owners' Association Act.
The Property will be sold subject to: 1) any outstanding ad valorem taxes (including taxes which are a lien but not yet due and payable), 2) the lien of any first priority mortgage covering the Property and the lien of any mortgage recorded prior to the recording of the Declaration, 3) the lien of any secondary purchase money mortgage covering the Property, provided that neither the grantee nor any successor grantee on the mortgage is the seller of the Property; and 5) any easements, encumbrances, zoning ordinances, restrictions, covenants and matters of record superior to the association lien first set out above.
