NOTICE OF MEETING AND ATTORNEY-CLIENT CLOSED DOOR SESSION
GATEWAY SERVICES COMMUNITY DEVELOPMENT DISTRICT
Notice is hereby given that the Board of Supervisors of the Gateway Services Community Development District (the "District") will hold its Regular Board meeting on October 16, 2025 at 2:00 p.m., at the District offices at 13240 Griffin Drive, Ft. Myers, Florida, 33913, and at its Regular Board Meeting on October 16, 2025, will hold a private, closed door attorney-client session for the pending litigation listed below, pursuant to Section 286.011(8), F.S., to commence on October 16, 2025 at 2:00 p.m., or as soon thereafter as possible, at the aforesaid District offices. The closed door attorney-client session will be held between the District Board of Supervisors, Supervisors Doug Banks, Robert Geppert, Ed Tinkle, Carole Pankau and Flavia Walsh; Anthony P. Pires, Jr. and Zachary Lombardo, (as District Counsel) Jeffrey W. Hurcomb (as Special Counsel); Chelsea O'Riley, District Manager (as the District's Chief Administrative or Executive Officer); and, a certified court reporter, to discuss pending litigation to which the District is presently a party before a court in Lee County, Florida styled Devin Chamberlin, and Brandon Chamberlin, Her Husband, Plaintiffs, vs. Gateway Services Community Development District; Mainscape, Inc.; and JSM Services, Inc., Defendants, Lee County Circuit Case #25-CA-001271. The District Counsel has advised the Board at a public meeting that he/they, as District Counsel, desire(s) advice concerning the pending litigation. The subject matter of the closed-door attorney-client session shall be confined to settlement negotiations or strategy sessions related to litigation expenditures with the estimated length of the session to be approximately one hour. Pursuant to Florida law, the entire closed-door attorney-client session shall be recorded by a certified court reporter who shall record the times of commencement and termination of the session, all discussion and proceedings, the names of all persons present at any time, and the names of all persons speaking. No portion of the session shall be off the record. The court reporter's notes shall be fully transcribed and filed with the clerk of the District and shall be made a part of the public record upon conclusion of the pending litigation. After the termination of the aforesaid closed-door attorney-client session, the Board may at the regular meeting take action or provide direction to the District Counsel and Special Counsel. The agenda for the meeting may be obtained by going to the District's website one week before the meeting. The meeting once convened, may be continued to a date and time certain, publicly announced at the meeting that is being continued, with a notice of the continued meeting date and time thereafter posted on the District website. At times, members of various committees or subcommittees established by the Board of Supervisors may be present at meetings of the Board of Supervisors and the members of those committees or subcommittees may participate at meetings of the Board of Supervisors as to matters being heard by the Board of Supervisors. Such committees include but are not limited to: Pelican Preserve Advisory Committee, Parks and Recreation Advisory Committee, and any other committee or subcommittee that may be established by the Board of Supervisors of the District. If any person decides to appeal any decision made by the Board with respect to any matter considered at these meetings, such person will need a record of the proceedings and such person may need to ensure that a verbatim record of the proceedings is made, at his or her own expense, and which record includes the testimony and evidence on which the appeal is based.
