By virtue and in execution of the Power of Sale contained in a certain mortgage given by West Deck Ventures LLC to Kiavi Funding Inc., dated September 11, 2024, and recorded with the Bristol County (Southern District) Registry of Deeds in Book 15093 at Page 251 of which mortgage the undersigned is the present holder by an assignment of mortgage From Kiavi Funding Inc., to U.S. Bank National Association, as Indenture Trustee, for LHOME MORTGAGE TRUST 2024-RTL3, Mortgage-Backed Notes, Series 2024-RTL3 dated August 15, 2025 and recorded in Bristol County (Southern District) Registry of Deeds in Book 15299, Page 418; by a corrective assignment of mortgage from Kiavi Funding Inc., to U.S. Bank National Association, as Indenture Trustee, for LHOME MORTGAGE TRUST 2024-RTL3, Mortgage-Backed Notes, Series 2024-RTL3 dated August 22, 2025 and recorded in Bristol County (Southern District) Registry of Deeds in Book 15303, Page 546; by corrective assignment of mortgage from Kiavi Funding Inc. to U.S. Bank National Association, as Indenture Trustee, for LHOME MORTGAGE TRUST 2024-RTL3, Mortgage-Backed Notes, Series 2024-RTL3 dated September 16, 2025, and recorded in Bristol County (Southern District) Registry of Deeds in Book 15314, Page 513. For breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 1:00 P.M. on the 7th day of January 2026, at 1587 Purchase Street, New Bedford, MA 02740, all and singular the premises described in said mortgage,
To wit:
The land in New-Bedford, Bristol County, Commonwealth of Massachusetts, together with any buildings thereon bounded and described as follows:
Beginning at a bound stone in the west line of Purchase Street and distant southerly therein fifty-five and 89/100 (55.89) feet from the southerly line of Merrimac Street
Thence Southerly in said West line of Purchase Street fifty-six and 55/100 (56.55) feet to a drill hole;
Thence Westerly in line of other land of the New Bedford Institution for Savings, ninety-nine and 33/100 (99.33) feet to land now or formerly of George A. Alallah;
Thence Northerly in line of last-named land and land of Celia Rosenblume, et al. fifty-six and 55/100 (56.55) feet to land of Frank J.G. Brenton; and
Thence Easterly in line of last-named land and Land of John Saba, ninety-nine and 33/100 (99.33) feet to the said west line of Purchase Street and the point of beginning.
Premises to be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed.
Terms of sale: A deposit of ten thousand dollars ($10,000) by certified or bank check will be required to be paid by the purchaser at the time and place of sale. The balance is to be paid by wire transfer to Demerle & Associates P.C., 10 City Square, 4th Floor, Boston, MA 02129 within thirty (30) days from the date of sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price. In the event of an error in this publication, the description of the premises contained in said mortgage shall control.
