37 Third Street, Swansea, MA 02777
By virtue and in execution of the Power of Sale contained in a certain mortgage given by James W. Shaw, Delores Cabeceiras, and Elaine M. DaSilva to St. Anne's Credit Union of Fall River, Mass, dated February 7, 1997, and recorded with the Bristol County (Fall River District) Registry of Deeds in Book 3201 at Page 143, of which mortgage the undersigned is the present holder. For breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 11:00 A.M. on the 28th day of January 2026, at 37 Third Street, Swansea, MA 02777, all and singular the premises described in said mortgage,
To wit:
A certain tract or parcel of land with the buildings and improvements thereon, if any, situated in the Town of Swansea, County of Bristol, Commonwealth of Massachusetts, being further bounded and described as follows:
Beginning at the Northeasterly corner of Little Neck Avenue and Third Street for a corner; thence running NORTHERLY in the Easterly line of said Little Neck avenue sixty (60) feet to Lot No. 54 on plan hereinafter referred to for a corner; thence running EASTERLY by said last-named land ninety (90) feet to Lot No. 56 on said plan for a corner; thence running SOUTHERLY by said last-named land sixty (60) feet to Third Street for a corner and thence running WESTERLY in the Northerly line of said Third Street ninety (90) feet to the point of beginning.
CONTAINING Five Thousand Four Hundred (5,400} square feet of land, more or less, and being Lot No. 55 as shown on plan of Little Neck Island belonging to Eugene Munsey, surveyed by Leo W. Grenier, Registered Land Surveyor, June 1947.
Subject to the restrictions as recorded in Book 512, Page 330 of the Bristol County Fall River District Registry of Deeds.
Being the same premises conveyed to these mortgagors by deed of Daniel F. Carvalho, Jr. of even date to be recorded herewith with the Bristol County Fall River District Registry of Deeds.
Premises to be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed.
Terms of sale: A deposit of ten thousand dollars ($10,000) by certified or bank check will be required to be paid by the purchaser at the time and place of sale. The balance is to be paid by wire transfer to Demerle & Associates P.C., 10 City Square, 4th Floor, Boston, MA 02129 within thirty (30) days from the date of sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price. In the event of an error in this publication, the description of the premises contained in said mortgage shall control.
