By virtue and in execution of the Power of Sale contained in a certain mortgage given by Louise Hopkins, as Trustee of 768 Old Bass River Realty Trust, under Declaration of Trust dated October 20, 2014, a Trustee's Certificate for which is recorded with the Barnstable County Registry of Deeds in Book 31392, Page 62, to Raymond C. Green Funding, LLC, dated May 21, 2024, and recorded at the Barnstable County Registry of Deeds in Book 36375, Page 198; as affected by an Affidavit Under MGL Chapter 183, Section 5B dated April 2, 2025, and recorded at the said Registry in Book 36903, Page 75, of which mortgage the undersigned is the present holder, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 12:00 P.M. on the 6th day of November 2025, at 311 Paddocks Path, Dennis, MA 02638, all and singular the premises described in said mortgage,

A certain parcel of land situated in Dennis, Barnstable County, Massachusetts, bounded and described as follows:
Being the land shown on a compilation plan of land entitled "Plan of Land in Dennis, Mass. owned by the Estate of Richard P. Wheatley, Mass Scale 1"=20', July 1, 2010, The Russell A. Wheatley Co., Inc. Land Surveyors & Engineers, 700 Bedford Street, Abington, Mass." said plan having been recorded with Barnstable County Registry of Deeds on Nov. 3, 2010 in Plan Book 637, Page 40, to which plan reference is hereby made for a more particular description.
For title see Deed of Russell A. Wheatley and R. Andrew Burbine, as Co-Executors of the Estate of Richard P. Wheatley and as Co-Trustees of the Richard P. Wheatley Trust, dated October 21, 2014 and recorded with the Barnstable County Registry of Deeds in Book 28466, Page 214.
Premises collectively to be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed.
Terms of sale: A deposit of twenty five thousand dollars ($25,000.00) by certified or bank check will be required to be paid by the purchaser at the time and place of sale. The balance is to be paid by wire transfer to Ligris + Associates, P.C., 1188 Centre Street, Newton, MA 02459 on or before thirty (30) days from the date of sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price.
