NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Joseph G. Forte, Jr. to Mortgage Electronic Registration Systems, Inc., as nominee for People's Choice Home Loan, Inc. dated April 28, 2004, registered at the Plymouth County Registry District of the Land Court as Document No. 564403 and noted on Certificate of Title No. 102838; said mortgage was then assigned to U.S. Bank National Association, as Trustee, Successor in Interest to Bank of America, National Association as Trustee as Successor by Merger to LaSalle Bank National Association, as Trustee for Certificateholders of Bear Stearns Asset Backed Securities I LLC asset backed Certificates Series 2004-HE7 by virtue of an assignment dated March 19, 2013, and registered as Document No. 00706101; said mortgage was then assigned to U.S. Bank Trust Company, National Association, as Trustee, as successor-in-interest to U.S. Bank National Association, as trustee, on behalf of the holders of the Bear Stearns Asset Backed Securities I Trust 2004-HE7, Asset-Backed Certificates, Series 2004-HE7 by virtue of an assignment dated September 18, 2024, and registered as Document No. 00856258; of which mortgage the undersigned is the present holder for breach of conditions of said mortgage and for the purpose of foreclosing the same will be sold at PUBLIC AUCTION at 11:00 AM on January 14, 2026, on the mortgaged premises. This property has the address of 17 Winthrop Road, Plymouth, MA 02360. The entire mortgaged premises, all and singular, the premises as described in said mortgage:
That certain parcel of land with the buildings thereon in Plymouth, Plymouth Count, Massachusetts, described as follows:
Being lots 37 and 38 on sheet 2 of subdivision Plan #13196B drawn by Delano & Keith Surveyors, dated May 25, 1949, filed with Certificate of Title No 13428.
Said Lot 37 is subject to the reservations set forth in a certain deed from Manomet Beach Shores, Inc., to Albert F. McCarthy et ux dated April 27, 1950, filed and registered as document #34022.
Said Lot 38 is subject to the reservations set forth in a certain deed from Manomet Beach Shores, Inc. to Francis Silva et ux dated November 21, 1950, filed and registered as document #36314.
Said Lot 38 is also subject an easement from Manomet Beach Shores, Inc., to the Aqua Corporation, dated July 7, 1950, filed and registered as document #35039.
Said lots are also subject to and have the benefit of all easements, covenants, conditions, rights of way, agreements and stipulations set forth or referred to in Certificate of Title No 13428 and document #31231.
Siad Lots are also subject to any rights acquired by the Town of Plymouth by reason of taking, dated May 10, 1976, filed and registered as document #170359.

Subject to and with the benefit of easements, reservation, restrictions, and taking of record, if any, insofar as the same are now in force and applicable. In the event of any typographical error set forth herein in the legal description of the premises, the description as set forth and contained in the mortgage shall control by reference. Together with all the improvements now or hereafter erected on the property and all easements, rights, appurtenances, rents, royalties, mineral, oil and gas rights and profits, water rights and stock and all fixtures now or hereafter a part of the property. All replacements and additions shall also be covered by this sale.
Terms of Sale: Said premises will be sold subject to any and all unpaid taxes and assessments, tax sales, tax titles and other municipal liens and water or sewer liens and State or County transfer fees, if any there are, and TEN THOUSAND DOLLARS ($10,000.00) in cashier's or certified check will be required to be paid by the purchaser at the time and place of the sale as a deposit and the balance in cashier's or certified check will be due in thirty (30) days, at the offices of Doonan, Graves & Longoria, LLC ("DG&L"), time being of the essence.
