NOTICE OF PUBLIC HEARING
BOROUGH OF BEACH HAVEN LAND USE BOARD
PLEASE TAKE NOTICE:
That MIH Coastal Holdings, LLC (the "Applicant") has filed an Application for Land Development with the Land Use Board of the Borough of Beach Haven (the "Board") for Amended Preliminary and Final Site Plan Approval, Preliminary and Final Major Subdivision Approval and Variance Approval for property known as Block 148.01, Lots 1, 2, 3 and 4, located at 601 2nd Street, the Queen City Marina, in the Marine Commercial ("MC") Zoning District of the Borough of Beach Haven (the "Property").
The Property is improved with the Queen City Marina, boat slips, boat repair facility, ship store and other site improvements. The Board, as memorialized by Board Resolution No. 2024-07, approved a free standing restaurant use to be developed on the Property.
The Applicant is now proposing to subdivide a 27,000 square portion of the Property into four (4) 5,000 square foot residential lots and one (1) 7,000 square foot residential lot, each with Pennsylvania Avenue frontage. Amended Site Plan Approval is required as (i) the Applicant is proposing to reduce the size of the approved restaurant from 17,054 square feet to 7,536 square feet, inclusive of all building and deck areas, within the same footprint as the approved restaurant, and (ii) the proposed subdivision will reduce the number of parking spaces for the marina, boat slips, ship store and approved restaurant uses from the 160 spaces shown on the site plan approved for the restaurant use to 138 in-season parking spaces (not including the six (6) parking space credit for each of the proposed electric vehicle parking spaces) and 93 parking spaces (not including the said six (6) electric vehicle parking space credit) and 109 dry boat slips provided during the marina's off-season. Seventy-eight (78) parking spaces are required for the marina, boat slips, ship store, reduced restaurant and public access. The Applicant is also proposing to replace the existing bathhouse with a mobile bathroom facility.
The existing impervious coverage for the Property's 164,657 square foot upland area is 100%. The proposed impervious coverage of the portion of the Property occupied by the marina, ship store and approved restaurant will be reduced to 96.37%. The impervious coverage for each residential lot will not exceed the 60% maximum for residential uses within the Marine Commercial District. The impervious coverage for the entire upland area of the Property, including the marina, ship store, reduced restaurant and proposed residential lots, will be reduced from the existing 100% to 90.4%.
To the extent deemed necessary by the Board or the Board's professionals, the Applicant is requesting a one (1) year extension to the site plan approval memorialized by Board Resolution 2024-07, or in the alternative Preliminary and Final Major Site Plan for the marina, boat slips, ship store, public access, mobile bathroom facility and reduced size restaurant.
No variances are known to be required for the proposed development of the Property. During the proceeding, the Board may be asked to render interpretations of the Ordinances of the Borough of Beach Haven as they apply to the Application. No other relief is known to be required. However, the Applicant is seeking approval of the plans that are on file with the Board Secretary. To the extent that additional approvals, variances, waivers and exceptions are needed to implement these plans, those approvals, variances, waivers and exceptions are being sought, including a variance pursuant to N.J.S.A. 40:55D-70(d)(1) if the Board or the Board's professionals deem the dry boat slips as a use not permitted in the Borough's Marine Commercial Zoning District.
The Board will hold a Public Hearing on the Application on Monday, July 6, 2026, at 6:00 p.m. or as soon thereafter as the matter may be heard, at the Beach Haven Municipal Building, 300 Engleside Avenue, Beach Haven, New Jersey. The Applicant reserves the right to supplement the submission either prior to or at the public hearing scheduled in this matter. At the hearing, or at any adjourned hearing date or location, all interested in the application will be afforded an opportunity to speak or otherwise to exercise the right granted to them under the Municipal Land Use Law of the State of New Jersey, N.J.S.A. 40:55D-1, et seq.
