PLEASE TAKE NOTICE that on Thursday, May 7, 2026 at 7:30 P.M., in the City of Elizabeth City Council Chambers, third floor of City Hall, 50 Winfield Scott Plaza, Elizabeth, New Jersey, the Planning Board ("Planning Board") will hold a public hearing on the application of J & D Holdings & Associates, LLC (the "Applicant"), seeking Preliminary and Final Site Plan approval and bulk ("c") variances in connection with the property located at 464-470 Rahway Avenue, Elizabeth, New Jersey, further identified as Block 374 and Lot 76 on the Tax Maps of the City of Elizabeth (the "Property"). The Property is in the City's C4 (Special Commercial) Zone District ("C4 Zone") and was previously improved with a Wells Fargo Bank and Drive-Thru ATM. The applicant had previously appeared before the Board concerning this application on December 4, 2025, and January 15, 2026, which resulted in a denial of the application. The Applicant has revised the site plan and is now seeking reconsideration of the denial.
The Applicant proposes to Use the property as a used car dealership, a permitted use, displaying 3 vehicles for sale and an additional 2 vehicles in the converted drive thru area. The Existing Wells Fargo ATM is to remain.
The Applicant is requesting relief for the following Bulk (c) variances for:
Minimum Lot Frontage: required: 150 ft, existing and proposed: 97.48 ft;
Minimum Lot Width: required: 150 ft, existing and proposed: 95.08 ft;
Front Yard Setback (Rahway Ave): required: 22.37 ft, existing and proposed: 15 ft;
Front Yard Setback (Hayes Ave): required: 10.9 ft, existing and proposed: 7.9 ft;
Rear Yard Setback: required: 35 ft, existing and proposed: 21.09 ft;
Maximum Impervious Coverage: permitted: 75%, existing: 81.71% and proposed: 79.48 %;
Min. Buffer to Residential Zone: required 10 ft, existing and proposed 3.63 ft.;
Off-Street Parking: required: 10 spaces, existing 8 spaces, and proposed: 6 spaces;
Min. Landscaping (parking area): 20 % required, 12 % proposed:
Min. Side Yard Setback (parking): 3 ft. required; 0 ft existing and proposed; and
Pole Sign: not permitted / existing and proposed
Applicant further seeks any additional deviations, variances, waivers, exceptions, interpretations, de minimis exceptions to RSIS, modifications of conditions of prior approvals, continuation of any preexisting nonconforming conditions and other approvals reflected on the filed plans (as same may be further amended or revised from time to time without further notice) and/or relief that may be determined to be necessary during the review and processing of the application and/or based upon an analysis of the plans and testimony at the PUBLIC HEARING on the Application. The Applicant reserves the right to supplement its submission either prior to or at the PUBLIC HEARING on this matter.
Beginning ten (10) days prior to the public hearing, Application documents will be available for public inspection on the City of Elizabeth's website at www.elizabethnj.org or may be inspected at the Office of the Bureau of Construction and Zoning, Division of Zoning and Land Use, 50 Winfield Scott Plaza, Elizabeth, New Jersey, during that Office's normal business hours.
