NOTICE OF PUBLIC HEARING ON ADOPTION OF CERTAIN PROPOSED
TEXT AMENDMENTS TO THE UNIFIED DEVELOPMENT ORDINANCE FOR THE TOWN OF BROWNSBURG, HENDRICKS COUNTY, INDIANA
Property owners of the Town of Brownsburg, Indiana (the "Town") and other interested parties are hereby notified that a public hearing by the Brownsburg Advisory Plan Commission (the "Plan Commission") will be held at 6:00 p.m., local time, on Monday, July 27, 2026, at Brownsburg Town Hall, 61 North Green Street, Brownsburg, Indiana, on the matter of the requirements set forth in House Enrolled Act 1001 ("HEA 1001") adopted by the Indiana General Assembly in the 2026 Session and certain text amendment updates to the Town's Unified Development Ordinance ("UDO").
HEA 1001, among other things, requires that not later than January 1, 2027, the Town conduct a public hearing to review the UDO and any zoning regulations and land development rules, with the goal of increasing housing development by using the following factors: (1) providing for higher density development of duplexes, triplexes, and fourplexes in areas designated for single family homes; (2) constructing other housing types including accessory dwelling units and manufactured and modular housing; (3) adaptive reuse of commercial buildings for residential use such as allowing multifamily development in retail, office, and light manufacturing zones; (4) increasing the allowable floor area ratio in multifamily housing areas; (5) waiving or eliminating regulations such as requirements for: (A) garage size and placement; (B) steeper roof pitch; (C) minimum lot size and square footage; (D) greater setbacks; (E) off-street parking; (F) design standards that restrict or prohibit the use of code compliant products; or (G) property height limitations; (6) reviewing impact fee zones with zone advisory committee for improvements; (7) streamlining or shortening the permitting processes and timelines, including through one stop and parallel process permitting by fifteen (15) days or more; (8) using property tax abatements to enable higher density and mixed income communities; and (9) donating vacant land for affordable housing development.
The proposed text amendments include: (1) adding a Legislative History Table that includes previous UDO amendments by Ordinance Number, Topic and Approval Date; (2) deleting "Data Center" as a permitted use in all districts; (3) adding "Information Processing Facility" as a permitted use in certain districts and as a Special Exception in IS (Institutional); (4) adding and/or revising that elementary, middle and high schools are a permitted use in all districts; (5) adding "56th Street/East CR 600 North" to the list of thoroughfares with use restrictions; (6) adding "56th Street/East CR 600 North" to list of thoroughfares with use restrictions; (7) clarifying that an escape lane must be exclusive from the drive-through and stacking lane(s) and parking areas; (8) clarifying fueling canopy signs are wall signs and the distinction between canopy signs and awning signs; (9) adding either a Traffic Impact Study (TIS) or Traffic Operation Analysis (TOA) as an application requirement for rezone petitions and specifying that the Administrator may waive this requirement; (10) adding either a Traffic Impact Study (TIS) or Traffic Operation Analysis (TOA) as an application requirement for DPR petitions, if not required in a previous step; (11) revising the definition of "Accessory Dwelling Unit" per Indiana Code; (12) revising the definition of "Applicant" per Indiana Code; (13) creating a new definition of "Canopy Sign"; (14) revising the definition of "Data Center" to better reflect the current use classification; (15) creating a new definition, "Information Processing Facility" to differentiate facilities that are used for employees who process, interpret or store data for use by an organization; (16) deleting the definition of "Owners' Association" and replacing it with "Homeowner's Association" per Indiana Code; and (17) revising the definition of "Structure" to reflect that the Indiana Code defines Class 1 and Class 2 structures.
A complete copy of proposed text amendments to the UDO is on file and available for examination at the office of the Town's Development Services Director located at the Brownsburg Town Hall, 61 North Green Street, Brownsburg, Indiana, during regular business hours.
Written comments regarding the proposed text amendments to the UDO may be filed with the Town's Development Services Director, on behalf of the Secretary of the Plan Commission, prior to the public hearing and will be considered by the Plan Commission. Oral comments concerning the proposed text amendments to the UDO will be heard at the public hearing. The public hearing may be continued from time to time as may be found necessary. Following the conclusion of the public hearing, the Plan Commission may consider a favorable recommendation, an unfavorable recommendation, or no recommendation of the proposed text amendments to the UDO from the Plan Commission to the Brownsburg Town Council.
