NOTICE OF PUBLIC HEARING
PLEASE TAKE NOTICE that upon the Application (#ZC2025-011) of Ariana Dadyan (the "Applicant"), the Voorhees Township Zoning Board of Adjustment (the "Board") shall conduct a public hearing on Thursday, October 23, 2025, commencing at 7:00PM, preceded by a caucus at 6:45PM in the Public Meeting Room of the Voorhees Township Municipal Building, located at 2400 Voorhees Town Center, Voorhees, New Jersey 08043, to consider an Application for a Zoning Interpretation and, if necessary, Use Variance Approval, for the development and use of a two-story addition to the existing single-family home located at 102 Alpha Avenue, identified as Block 7, Lot 2 on the official tax maps of Voorhees Township, within a Medium Density Residential (MDR) Zoning District (the "Property").
Applicant seeks the Board's interpretation of the following sections of the Voorhees Township Zoning Ordinance: §152.012(A), §152.012(A)(6), §150.13(A)(5), and §150.13(B)(1), pursuant to N.J.S.A. 40:55D-70(b), et seq., to confirm that the proposed two-story addition to the existing single-family residence should be considered as an enlargement of the principal single-family dwelling – as permitted within a Medium Density Residential (MDR) Zoning District, rather than a separate dwelling unit – which is not permitted. Specifically, the Applicant's proposed two-story addition involves an attached garage with an addition to the single-family residence on the second floor. The proposed second floor addition is only accessible internally, through the existing residence, and is not intended for use as a separate dwelling unit.
Applicant contends that because the proposed addition is: (i) attached to the residence and therefore considered part of the principal single-family dwelling rather than an accessory building, (ii) involves additional living space which is only accessible internally through the home, (iii) does not have a separate exterior entrance, (iv) does not have a separate kitchen facility, and (v) will not have separately metered utilities, the addition is consistent with the scope of improvements permitted under the Voorhees Township Zoning Ordinance.
Alternatively, if the Board determines that the proposed addition is not consistent with the above interpretation and is instead deemed to constitute an additional dwelling unit, the Applicant will then seek Use Variance Approval pursuant to N.J.S.A. 40:55D-70(d) to permit the construction of the proposed improvements, notwithstanding that the improvements are not intended to be used as a separate dwelling, and no change to the single-family use of the Property is proposed.
During the course of review of the Application and/or presentation of the Application it is possible that additional variances, submission waivers, design waivers, de minimus exceptions, interpretations, and/or other exceptions from the requirements of the Voorhees Township Unified Land Development Ordinance may be identified or deemed to be necessary to permit approval of the Application as submitted, or with such changes as may be requested or accepted by the Board. This notice is to advise you that such additional variance, exception, and/or waiver relief may be requested by the Applicant at the time of the hearing.
During the Board hearing on the Application, the Applicant will request that the Board grant any and all approvals, submission waivers, design waivers, variances, de minimus exceptions, interpretations, or other relief necessary to allow for the development and use of the Property as proposed by the Applicant, or with such changes as may be requested or accepted by the Board. This notice is also to advise you that such additional variance, exception, and/or waiver relief may be granted by the Board at the time of the hearing.
Anyone affected by this Application will have the opportunity to appear at the meeting of the Zoning Board of Adjustment to be held on Thursday, October 23, 2025, commencing at 7:00PM, preceded by a caucus at 6:45PM in the public meeting room of the Voorhees Township Municipal Building, located at 2400 Voorhees Town Center, Voorhees, New Jersey 08043, to present any support or objection they may have for the approval of this Application.
ACTION WILL BE TAKEN AT THIS MEETING. THIS MEETING WILL BE HELD IN COMPLIANCE WITH THE OPEN PUBLIC MEETINGS ACT pursuant to N.J.S.A. 10:4-8(b).
The Board may at its discretion, adjourn, postpone, or continue this hearing from time to time, and you are hereby notified that you should make diligent inquiry of the Board Secretary concerning any such adjournments, postponements, or continuations.
