NOTICE OF PUBLIC HEARING
Town Board of the Town of Hyde Park, Dutchess County, New York
PLEASE TAKE NOTICE that the Town Board of the Town of Hyde Park will hold a public hearing on Monday, December 8, 2025 at 6:30 p.m. or as soon thereafter as the matter is reached on the agenda, at the Meeting Room, Town Hall, 4383 Albany Post Road, Hyde Park, New York 12538, to hear all persons on the application of T-Rex Hyde Park Owner LLC for variations from lot and bulk controls applicable to proposed Buildings 100/200/300 as shown on a proposed Site Plan entitled "Construction Phase Site Plan, Bellefield Phase 2B: Sterling Apartments, prepared by Passero Associates and filed with the Town Planning Board on October 21, 2025. These proposed buildings are located on Lot 8 within the Bellefield Planned Unit Development, as shown on a Subdivision Plat prepared by LaBella Associates D.P.C., dated September 3, 2024 and last revised September 2, 2025, Sheets SP-1, SP-2, and SP-3 (the "Preliminary Plat") which received conditional preliminary plat approval from the Town of Hyde Park Planning Board on September 17, 2025. The Bellefield Planned Unit Development is located on the east side of NYS Route 9, and bounded on the south by West Dorsey Lane, and on the north by St. Andrews Road (Tax Parcel No. 133200-6163-01-131849).
The requested variations are:
a building height variation to permit a building height of 65 feet 4 inches, which is 19 feet 4 inches above the 46-foot permitted height identified in the Amended Concept/Comprehensive Development Plan for Bellefield adopted on December 20, 2021; and
a building length variation to permit a maximum west elevation length of 750 feet and an east elevation length of 507 feet, which lengths are, respectively 450 feet and 207 feet above the 300-foot permitted length identified in the Amended Concept/Comprehensive Development Plan.
Copies of the application materials, including the proposed site plan and the approved preliminary subdivision plat mentioned above, are available for public inspection at the Office of the Town Clerk and the Town Planning Board office during regular business hours, and video presentations of the proposed plans at Planning Board meetings are also available on the Town's website. Written comments may be submitted to the Town Clerk before 12:00 p.m. on the hearing date or may be delivered at the hearing. At the public hearing, all interested parties will be heard.
This matter has been referred to the Town of Hyde Park Planning Board for review and recommendation and to the Dutchess County Department of Planning & Development for review pursuant to General Municipal Law §239-m; the Town Board will consider any comments and recommendations received.
