NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that the Newark Higher Education Finance Corporation (the "Corporation"), a nonprofit corporation created by the City of Newark, Texas pursuant to Chapters 53 and 53A, Texas Education Code, will hold a public hearing on December 22, 2025, commencing at 10:00 a.m. to provide an opportunity for all interested persons to be heard with respect to its proposed bonds, in one or more series pursuant to a plan of finance (qualified 501(c)(3) bonds as defined in Section 145 of the Internal Revenue Code, as amended), in the maximum amount of $20,000,000 (the "Bonds").
Proceeds from the sale of the Bonds will be loaned to Texas Leadership Charter Academy, a Texas nonprofit corporation and an organization described in Section 501(c)(3) of the Internal Revenue Code, as amended (the "Borrower"), for the purpose of financing all or a portion of the costs of the acquisition, construction, renovation and equipping of educational and related facilities located at: (1) 5687 Melrose Ave. San Angelo, Texas 76901; (2) 3209 North 10th Street, Abilene, Texas 79601; (3) 3250 State St., Abilene, Texas 79603; and (4) 3302 State St., Abilene, Texas 79603 and refinancing debt used for the acquisition, construction, renovation and equipping of educational and related facilities located at (1) 3301 TLC Way San Angelo, Texas 76901 and (2) 5687 Melrose Ave, San Angelo, Texas 76901 (collectively, the "Project"). A portion of the proceeds of the Loans will be used to pay certain expenses in connection with the issuance of the Loans. The Project are or will be owned by the Borrower. The Loans are not payable out of taxes and are secured by and payable solely from funds provided by the Borrower.
At the time and place set for the public hearing, interested persons will be given a reasonable opportunity to express their views, both orally (via telephonic participation) and in writing, on the merits of the Project, the Bonds or related matters. Persons wishing to participate should submit a written request to speak to nvaldez@jw.com at least 24 hours before the hearing; however, the hearing officer will also provide time for additional comments during the hearing. Oral remarks may not exceed five minutes in duration.
