NOTICE OF PUBLIC HEARING
STOCKTON CITY COUNCIL TO APPROVE ENGINEER' S REPORT AND AUTHORIZE THE LEVY OF ASSESSMENTS REGARDING ANNEXATION TO STOCKTON CONSOLIDATED STORM DRAINAGE MAINTENANCE ASSESSMENT DISTRICT NO. 2005-1, VERONA ESTATES - ZONE 16
The formation of the Stockton Consolidated Storm Drainage Maintenance Assessment District No. 2005-1, City of Stockton, County of San Joaquin, State of California, (the "District") was approved and adopted by the City Council on July 26, 2005. At the direction of this City Council, Wong Engineers, Inc., as Engineer of Work ("Engineer of Work") for improvement proceedings in the annexation of the proposed Verona Estates - Zone 16 to the District has filed with the City Clerk the Engineer's Report described in Section 10204 of the Streets and Highways Code (Municipal Improvement Act of 1913, hereafter in this resolution referred to as "the Act") and in compliance with the Stockton Improvement Procedure Code ("Stockton Code") and containing the matters required by Article XlllD of the California Constitution ("Article XlllD"). It is appropriate for the City Council to approve said Engineer's Report and to hold a public hearing of protests respecting said Engineer's Report. A brief description of the proposed storm drainage improvements as described in said Engineer's Report is attached hereto as Attachment A. To fund the ongoing operation and maintenance of storm drain improvements, it will be necessary to form a new zone in the District. Formation of Zone 16 is conducted pursuant to the Municipal Improvement Act of 1913 (Act) and the Stockton Improvement Procedure Code (Stockton Municipal Code). The total amount of the proposed assessment chargeable to the record owner's parcel, the duration of the payments, the reason for the assessment and the basis upon which the amount of the proposed assessment was calculated is set forth in the Engineer's Report. The maximum annual assessment includes a yearly increase, which is the greater of three percent (3.00%), or the yearly increase of the Consumer Price Index (CPI) if required by increased maintenance costs. The public hearing on the proposed assessment is set for February 3, 2026 at 5:30 PM at the City Council Chambers, 425 N. El Dorado Street, Stockton, California, 95202. Verona Estates, Zone 16 will become part of this District by approving resolutions to be considered by the City Council at the meeting. In connection with the hearing, a ballot procedure will be conducted, with the owner of the parcel(s) affected by the assessment eligible to cast a ballot. Each ballot shall be finally due by submission to the City Clerk by mail, email or in person no later than the date and time of the hearing, and the ballot(s) will be tabulated by the City Clerk at the meeting. The assessment shall not be imposed if the ballots submitted in opposition to the assessment exceed the ballots submitted in favor of the assessment, with ballots weighted according to the proportional financial obligation of the affected property. Proceedings before the Stockton City Council are conducted in English. The City of Stockton does not furnish interpreters and if one is needed, it shall be the responsibility of the person needing one. If you challenge the proposed action in court, you may be limited to raising only those issues you or someone else raised at this public hearing, or in written correspondence delivered to the Office of the City Clerk at, or prior to, the public hearing.
