NOTICE OF PUBLIC HEARING

LAND USE BOARD
PLEASE TAKE NOTICE that Rugel Dream Properties, LLC (the "Applicant") has filed an application (the "Application") with the Town of Hackettstown Land Use Board, Warren County, New Jersey (the "Board"), for preliminary and final major site plan approval, minor subdivision, bulk variance relief and design waiver relief with respect to property located at 273-275 and 281-285 Main Street, Hackettstown, New Jersey, which is designated as Block 72, Lots 17 & 18 on the official Tax Map of the Town of Hackettstown (the "Property"). The Property is located in the Town's TCC (Town Center Commercial) Zone District.
The Applicant is seeking minor subdivision (lot line adjustment) approval and preliminary and final major site plan approval with bulk variance relief to construct a three-story mixed-use building on Lot 18 that would contain a general office use on the ground floor and four (4) two-bedroom residential rental apartment dwellings with surface parking facilities (located on Lot 17), lighting improvements, sidewalks, a new stormwater management system and landscaping. A general office use, which is a permitted use in the TCC Zone, is proposed for the first floor of the building. The four (4) residential rental apartment units are also a permitted use in the TCC Zone and are proposed to be located on the second and third floors of the proposed mixed-use building.
As stated above, the Applicant is also seeking minor subdivision (lot line adjustment) approval where an existing 675 s.f. (0.015 acres) portion of Lot 17 would be merged into Lot 18. Therefore, the proposed new compliant lot sizes are as follows: Lot 18: 6,825 s.f. (0.157 acres) and Lot 17: 32,387 s.f. (0.744 acres).
The Applicant seeks the following variance relief pursuant to N.J.S.A. 40:55D-70(c)(1) and/or c(2) and with respect to the Town Code for the following pre-existing non-conformity which will remain unchanged:
1. Section 406D. of the Town Land Development Ordinance – Side Yard - 0.8 feet for southern side lot line setback on Lot 17, where a 6-foot side yard setback is required.
The Applicant seeks the following variance relief pursuant to N.J.S.A. 40:55D-70(c)(1) and/or c(2) and with respect to the Town Code:
1. Section 406F. of the Town Land Development Ordinance – Minimum Number of Parking Spaces – 31 spaces are required; 24 spaces are proposed.
The Applicant also seeks design waiver relief for the following pursuant to N.J.S.A. 40:55D-51 and with respect to the Town Code:
Section 508A.1 – Parking Lot Landscaping - The Town Code requires a screen planting, berm, fence, wall or combination thereof, no less than five (5) feet in height shall be provided between off-street parking areas for more than ten (10) vehicles and any lot line. The Applicant does not propose parking lot landscaping.Section 508A.3.a – Parking Lot Landscaping - The Town Code requires at least 5% of the interior parking area be landscaped with plantings, and one (1) tree for each ten (10) spaces shall be installed. These required plantings are exclusive of other planting requirements, such as for street trees or buffers. The Applicant does not propose parking lot landscaping.Section 508E – Parking Lot Location – The Town Code requires that off-street parking and loading spaces shall be located on the same lot or premises as the use served, regardless of the number of spaces required, except that in cases when it is determined during site plan review that the requirements for on-site off-street parking cannot be met because of existing conditions, the location and adequacy of off-site parking spaces to service the use shall be specified on the site plan for approval by the Planning Board. Parking for Lot 18 is proposed to be located on Lot 17.Section 508C.4 – Curbing – The Town Code requires curbing around off-street parking. The Applicant does not propose curbing around off-street parking.
In addition to the above approvals, the Applicant requests that the Application be deemed amended to include, and that the Board grant any additional approvals, variances, exceptions, deviations, or waivers determined to be necessary or desirable in the review and processing of this application, whether requested by the Applicant, the Board or otherwise.
A public hearing on said application will be held by the Board on March 24, 2026, at 7:00 p.m., at the Municipal Building, 215 West Stiger Street, Hackettstown, New Jersey 07840 at which time any interested party may appear, if they so desire, either in person or by attorney and ask questions, cross examine witnesses and present testimony and any comments they may have with respect to the Application.
All maps and documents relating to the Application are on file in the Land Use Board Office in the Municipal Building, 215 West Stiger Street, Hackettstown, New Jersey at least ten (10) days prior to the hearing and are available for public inspection during regular municipal hours between 9:00 a.m. and 5:00 p.m., Monday through Friday (except holidays).
This notice is being sent to you by the Applicant as required by the Municipal Land Use Law (N.J.S.A. 40:55D-10 and 12) and by Order of the Town of Hackettstown Land Use Board.
