NOTICE OF PUBLIC HEARING
PLEASE TAKE NOTICE that on May 11, 2026 at 7:00 P.M. the Zoning Board of Adjustment of the Town of Secaucus will hold a public hearing at the Town of Secaucus, 1203 Paterson Plank Road, Secaucus, New Jersey, on the application of Chick-fil-A ("Applicant"), for a variance application approval for the property located at 450 Harmon Meadow Boulevard, Secaucus, New Jersey, designated as Block 227.01, Lot 3, on the Town of Secaucus Tax Map ("Property").
Applicant, with authorization from Property Owner Hartz Mountain Industries, Inc., proposes to demolish an existing restaurant (formerly Red Robin Restaurant) and construct a new fast food restaurant with drive-thru, which is a permitted use within the New Jersey Sports and Exposition Authority's ("NJSEA") Regional Commercial Zone. The purpose of Applicant's variance application is to request nine (9) bulk variances for associated site improvements with the proposed development under the following NJSEA regulations:
(1) Under N.J.A.C. § 19:4-8.4 (a)59 of the NJSEA regulations, a quick service restaurant requires one (1) 12 feet by 60 feet (12'x60') loading space. Applicant proposes no loading spaces. Applicant is requesting a loading variance.
(2) Under N.J.A.C. § 19:4-8.14 (h)4 of the NJSEA regulations, a maximum gross sign area of 5% of the building main façade is permitted. Applicant proposes a total gross sign area of 238.26 square feet, where the maximum gross sign area permitted is 97.45 square feet based on the proposed building main façade. Applicant is requesting a sign variance.
(3) Under N.J.A.C. § 19:4-5.49 (a)3ii of the NJSEA regulations, a 30-foot side yard setback is required. Applicant proposes a trash enclosure that is 7.1 feet from the property line. Applicant is requesting a side yard setback variance.
(4) Under N.J.A.C. § 19:4-5.49 (a)3i of the NJSEA regulations, a 50-foot front yard setback is required. Applicant proposes a meal order canopy that is 27 feet from the property line. Applicant is requesting a front yard setback variance.
(5) Under N.J.A.C. § 19:4-8.2 (c)1 of the NJSEA regulations, six (6) feet of landscaped open space between a building and vehicle use areas is required. Applicant proposes sidewalk/hardscape on all four sides. Applicant is requesting a landscape buffer variance.
(6) Under N.J.A.C. § 19:4-8.12 (c) of the NJSEA regulations, when a sidewalk abuts a curb or edge of pavement, the minimum width shall be six (6) feet. Applicant proposes a five (5) foot-wide sidewalk. Applicant is requesting a sidewalk width variance.
(7) Under N.J.A.C. § 19:4-8.15 (f)8 of the NJSEA regulations, recycling and refuse areas are required to be screened […] no elements of these areas, including materials contained therein, shall be higher than the surrounding screening, and in no case greater than eight (8) feet. Applicant proposes an eight-foot, eight-inch (8'-8") screening. Applicant is requesting a refuse screening height variance.
(8) Under N.J.A.C. § 19:4-8.13 (a)2 of the NJSEA regulations, illumination levels in these areas shall maintain an average-to-minimum uniformity ratio not to exceed 4:1. Applicant proposes a 4.08:1 ratio. Applicant is requesting a lighting ratio variance.
(9) Under N.J.A.C. § 19:4-8.9 (d)6iv of the NJSEA regulations, All site service improvements and utility improvements, such as transformer compounds and external heating and cooling equipment; refuse and recycling areas; and outdoor storage, display or work areas, where permitted, shall be enclosed by a solid and continuous fence, wall, or evergreen plant material sufficient to screen such activity from adjacent properties and public right-of-ways. Applicant proposes partial screening due to underground utility conflicts. Applicant is requesting a screening variance.
If required, Applicant also intends to request at the hearing such other deviations, variances and/or waivers of design standards and/or submission requirements as the Zoning Board of Adjustment may deem necessary to develop the property in the manner indicated in the application plans and materials.
The application and all supporting maps, site plans and documents are on file in the office of the Zoning Board of Adjustment at the Town of Secaucus, New Jersey, and are available for public inspection, Monday through Friday, during normal business hours, except holidays. Any interested party may appear at the aforesaid hearing, either in person or by their attorney, and be given an opportunity to be heard with respect to the application.
THIS NOTICE is being provided by the Applicant in accordance with the laws of the State of New Jersey and by Order of the Zoning Board of Adjustment of the Town of Secaucus, New Jersey.
