NOTICE OF PUBLIC HEARING AND ASSESSMENT INFORMATION CITY OF STOCKTON FIVE MILE SLOUGH ASSESSMENT DISTRICT NO. 26-1 The City of Stockton has proposed the formation of an assessment district to fund annual maintenance, invasive weed control, repair, and capital improvement projects on along an approximately 2.7 mile stretch of Five Mile Slough. The proposed new assessment district will be known as the Five Mile Slough Assessment District ('District'). If approved, annual assessments will be collected via property tax bills beginning FY 2027-2028.
NOTICE IS HEREBY GIVEN that the City Council will hold a Public Hearing on the proposed Five Mile Slough Assessment District at Council Chambers of City Hall, 425 North El Dorado Street, Stockton on: June 9, 2026, at 5:30 p.m., or as soon thereafter as possible. You are invited to provide oral or written testimony at the Public Hearing. All proceedings before this meeting body are conducted in English. ASSESSMENT BALLOT PROCEEDING
This ballot proceeding in accordance with Proposition 218 (Section 4(c) and XIII D of the California Constitution) to form a new assessment district to the provisions of the Landscaping and Lighting Act of 1972 (Streets and Highways Code Section 22500, et seq.). Our records indicate that you are the record owner of the parcel identified above on this notice. An assessment ballot is enclosed on which you may indicate your support for, or opposition to, the proposed assessment. Instructions for completing the ballot are enclosed. In the event of a majority protest, the assessment will not be imposed. A majority protest will exist if the assessment ballots submitted, and not withdrawn, in opposition to the assessment exceed the ballots submitted, and not withdrawn, in favor of the assessment. In making this determination, assessment ballots will be weighted by the proportional financial obligation (i.e. the amount of the assessment) for the property for which the ballot is submitted.
ASSESSMENT INFORMATION
Proposed Improvements: The proposed improvements to be funded by this assessment include the maintenance, operation and related tasks associated with water quality and vegetation management functions within Five Mile Slough. There is no existing funding mechanism to provide adequate revenue to fund the desired improvements. If the new District and assessments are approved, operation, maintenance and servicing of the Improvements will be provided under the new District. For more information, including a complete description of the assessment formula and further details on how the special benefits were derived, refer to the Engineer's Report preliminarily approved for the District, which is available at the City Clerk's Office located at 425 North El Dorado Street, Stockton. Boundaries of the Proposed District: The boundary of the District runs along a 2.7 mile stretch of Five Mile Slough and Five Mile Creek, within the City of Stockton, and the assessment diagram is on file with the City Engineer. Total Proposed Fiscal Year 2027-2028 District Assessment: The total amount of the proposed assessment chargeable to the entire District for Fiscal Year 2027-2028 is $87,878.60. Proposed Fiscal Year 2027-2028 Parcel Assessment: The amount of the proposed assessment chargeable to your specific parcel identified above for Fiscal Year 2027-2028 is identified on your included ballot, and may be obtained by contacting the City Engineering Representative, Siegfried Engineering at 209-943-2021. Duration of Proposed Assessment: The proposed assessment for the District will be levied annually beginning with Fiscal Year 2027-2028 and will continue until the City Council determines to discontinue the levy or the District is
dissolved.
ASSESSMENT BALLOT SUBMISSION INSTRUCTIONS AND PROCEDURES
For your ballot to be counted, you must complete the following steps: If you are returning your assessment ballot by mail, you must affix appropriate postage. Regardless of the postmark, you must allow sufficient time to ensure that the assessment ballot is received by the City Clerk by June 9, 2026 at 5:30 pm. Alternatively, you may deliver your assessment ballot to City Clerk in person at the City Clerk's Office Monday-Friday during regular business hours, excluding weekends, and holidays, at the following address: 425 North El Dorado Street, Stockton. Ballots will also be accepted during and prior to the conclusion of the Public Hearing. The Public Hearing is scheduled to begin on June 9, 2026 at 5:30pm, or as soon thereafter as possible, and will take place at the City Council Chambers at 425 North El Dorado Street, Stockton. The Public Hearing may be continued from time to time.
PROPORTIONAL ASSESSMENT BALLOTS
If a parcel has multiple record owners, any owner may request a proportional assessment ballot. If more than one of the record owners (or the authorized representative of a record owner) submits a ballot, the amount of the assessment shall be allocated to each ballot in proportion to the respective record ownership interests, or if the ownership interests are not shown on the record, as established to the satisfaction of the City by documentation provided by the record owners. REPLACEMENT BALLOTS
If you have lost, spoiled, damaged, or never received your assessment ballot, or if you wish to change your vote on a previously submitted assessment ballot, please call the telephone number below for information on how you may obtain a replacement assessment ballot. Additionally, you may receive a replacement assessment ballot at the Public Hearing. The deadlines outlined above for the return of assessment ballots apply to replacement assessment ballots.
TABULATION OF BALLOTS
The City Council designated the City Clerk together with the assistance of City staff and Siegfried Engineering, working under the direction of the City Clerk, to tabulate the assessment ballots submitted and not withdrawn, in support of or in opposition to the proposed assessment. Following the conclusion of the Public Hearing, the assessment ballots shall be unsealed and tabulated in public view by City Clerk, with assistance from City staff and Siegfried, so as to permit all interested persons to meaningfully monitor the accuracy of the tabulation process. Assessment ballots may be tabulated by hand, by computer, or by any other tabulating device. The ballot tabulation shall take place on June 9, 2026 following the Public Hearing.
