A Judgment and Decree of Foreclosure, having been filed on September 18, 2025, by the Circuit Court for the SECOND Judicial Circuit, Minnehaha County, in the action entitled U.S. Bank Trust Company, National Association, as trustee, as successor-in-interest to U.S. Bank National Association, as Trustee, successor in interest to Bank of America, National Association, as Trustee, successor by merger to LaSalle Bank National Association, as Trustee for SACO I TRUST 2005-WM3 Mortgage-Backed Certificates, Series 2005-WM3 v. Heirs and devisees of George Kiggins, deceased, et al, Civ. 49CIV25-002048, which Judgment and Decree of foreclosure in part directed a foreclosure sale of the following described real property in Minnehaha County, South Dakota:
THE EAST 188 1/2 FEET OF THE WEST 246 1/2 FEET OF TRACT 89 OF NORTON TRACTS SUBDIVISION IN THE SOUTH HALF (S1/2) OF SECTION 3, TOWNSHIP 101 NORTH RANGE 49 WEST OF THE 5TH P.M. MINNEHAHA COUNTY, SOUTH DAKOTA, ACCORDING TO THE RECORDED PLAT THEREOF.
(aka 3018 N JESSICA AVE., SIOUX FALLS, SD 57104)
Together with all improvements, easements, rights and appurtenances on or accruing to such property;
NOTICE IS HEREBY GIVEN that for the purpose of realizing the sum of $19,117.76 as of August 21, 2025, plus interest accruing thereafter on said amount at the rate of 11.20% per year together with the costs and expenses of sale, will be sold subject to redemption as provided by law as one parcel of land at public auction subject to the lien for unpaid real estate taxes and assessments of Minnehaha County, South Dakota, and easements and restrictions of record, to the highest bidder for cash, by the Sheriff of Minnehaha County, at the Law Enforcement Center in Sioux Falls, South Dakota at the hour of 11:00 AM (CT) on November 19, 2025. Such property is that described in a security instrument dated May 31, 2005, recorded June 7, 2005 in R516828 Book 1510 of Mtgr Page 269; which mortgage was assigned to Mortgage Electronic Registration Systems, Inc. (MERS) by Assignment of Mortgage recorded June 11, 2007, in R717613 Book 1571 of Mtgs Page 895; which mortgage was assigned to U.S. Bank Trust Company, National Association, as trustee, as successor-in-interest to U.S. Bank National Association, as Trustee, successor in interest to Bank of America, National Association, as Trustee, successor by merger to LaSalle Bank National Association, as Trustee for SACO I TRUST 2005-WM3 Mortgage-Backed Certificates, Series 2005-WM3 by Assignment of Mortgage recorded June 02, 2023, in R108913 Book 1970 of Mtgs Page 307, executed by Ewla Heater and George Kiggins.
If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The purchaser shall have no further recourse against the Mortgagor or the Mortgagee's attorney.
