A Judgment and Decree of Foreclosure, having been filed on May 17, 2024, by the Circuit Court for the SECOND Judicial Circuit, Minnehaha County, in the action entitled Citizens Bank NA f/k/a RBS Citizens NA v. Jason Krause, et al, Civ. 49CIV22-002524, which Judgment and Decree of foreclosure in part directed a foreclosure sale of the following described real property in Minnehaha County, South Dakota:
TRACT 3 OF FREIBERG'S TRACTS IN THE SOUTHEAST QUARTER OF THE SOUTHWEST QUARTER (SE1/4SW1/4) OF SECTION 28, TOWNSHIP 101 NORTH, RANGE 51 WEST OF THE 5TH P.M., MINNEHAHA COUNTY, SOUTH DAKOTA, ACCORDING TO THE RECORDED PLAT THEREOF.
(aka 26695 APPLE LN, HARTFORD, SD 57033)
Together with all improvements, easements, rights and appurtenances on or accruing to such property;
NOTICE IS HEREBY GIVEN that for the purpose of realizing the sum of $333,079.35 as of March 18, 2024, plus interest accruing thereafter on said amount at the rate of 4.375% per year together with the costs and expenses of sale, will be sold subject to redemption as provided by law as one parcel of land at public auction subject to the lien for unpaid real estate taxes and assessments of Minnehaha County, South Dakota, and easements and restrictions of record, to the highest bidder for cash, by the Sheriff of Minnehaha County, at the Law Enforcement Center in Sioux Falls, South Dakota at the hour of 11:00 AM (CT) on November 19, 2025. Such property is that described in a security instrument dated December 21, 2018, recorded December 28, 2018 in Book 1852 of Mtgs on Page 823; which mortgage was assigned to Citizens Bank, N.A. by Assignment of Mortgage recorded August 11, 2020, in Book 1894 of Mtgs on Page 334, executed by Jason Krause and Jesse Krause, husband and wife as joint tenants with right of survivorship.
If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The purchaser shall have no further recourse against the Mortgagor or the Mortgagee's attorney.
