A Judgment and Decree of Foreclosure, having been filed on May 19, 2026, by the Circuit Court for the SECOND Judicial Circuit, Minnehaha County, in the action entitled Lakeview Loan Servicing, LLC v. Jason Nabity, et al, Civ. 49CIV26-001137, which Judgment and Decree of foreclosure in part directed a foreclosure sale of the following described real property in Minnehaha County, South Dakota:
LOT 3 IN BLOCK 3 OF DAKOTA IMPROVEMENT COMPANY'S FIRST ADDITION TO SIOUX FALLS, MINNEHAHA COUNTY, SOUTH DAKOTA, ACCORDING TO THE RECORDED PLAT THEREOF.
(aka 314 N FRANKLIN AVE., SIOUX FALLS, SD 57103)
Together with all improvements, easements, rights and appurtenances on or accruing to such property;
NOTICE IS HEREBY GIVEN that for the purpose of realizing the sum of $86,011.55 as of May 15, 2026, plus interest accruing thereafter on said amount at the rate of 3.25% per year together with the costs and expenses of sale, will be sold subject to redemption as provided by law as one parcel of land at public auction subject to the lien for unpaid real estate taxes and assessments of Minnehaha County, South Dakota, and easements and restrictions of record, to the highest bidder for cash, by the Sheriff of Minnehaha County, at the Minnehaha County Law Enforcement Center in Sioux Falls, South Dakota at the hour of 11:00 AM (CT) on July 22, 2026. Such property is that described in a security instrument dated January 29, 2016, recorded February 1, 2016 in Book 1791 of Mortgages Page 349; which mortgage was assigned to Lakeview Loan Servicing, LLC by Assignment of Mortgage recorded January 03, 2022, in Book 1943 of Mtgs Page 400, executed by Jason Nabity, a single person.
If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The purchaser shall have no further recourse against the Mortgagor or the Mortgagee's attorney.
