SUPREME COURT COUNTY OF Rockland, WILMINGTON TRUST, NATIONAL ASSOCIATION, NOT IN ITS INDIVIDUAL CAPACITY, BUT SOLELY IN ITS CAPACITY AS TRUSTEE FOR THE BENEFIT OF THE HOLDERS OF THE CERTIFICATES ISSUED BY FLAGSTAR MORTGAGE TRUST 2021-10, Plaintiff, vs. YAKOV BIRNHACK, ET AL., Defendant (s).
Pursuant to a Judgment of Foreclosure and Sale duly entered on October 3, 2025 and Decision and Order on Motion entered on October 6, 2025 I, the undersigned Referee will sell at public auction at the Rockland County Courthouse, Landing above the vestibule between Courtrooms One and Two, 1 South Main Street, New City, NY 10956 on January 7, 2026 at 11:00 AM, premises known as 94 WESTVIEW ROAD, SPRING VALLEY, NY 10977. All that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being in the Village of New Hempstead, Town of Ramapo, County of Rockland and State of New York, Section: 42.18, Block: 2, Lot: 86. Approximate amount of judgment is $490,447.43 plus interest and costs. Premises will be sold subject to provisions of filed Judgment Index # 032874/2023.
If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The Purchaser shall have no further recourse against the Mortgagor, the Mortgagee, the Mortgagee's attorney, or the Referee.
