Pursuant to a judgment of foreclosure and order of sale in the above-entitled action, dated February 3, 2026 and entered on February 4, 2026, I, the undersigned, the Referee of said judgment named, will sell at public auction at the Broome County Court House (basement level - inside lobby) in the City of Binghamton, County of Broome and State of New York on March 27, 2026 at 2:00 p.m., subject to covenants and restriction and easements of record, subject to violations, zoning regulations and ordinances of the city, town, village or county in which the premises lie, subject to existing leases, tenancies and occupancies, subject to all real property taxes, assessments, water and pollution control charges, subject to the liens of any prior judgments, mortgages or other encumbrances of record, subject to the right of redemption of the United States of America, if any, and subject to such state of facts that an accurate survey may disclose, the mortgaged premises directed in and by said judgment to be sold, commonly known as 306 Colesville Road, Binghamton, NY 13904 and described as follows:
ALL THAT TRACT OR PARCEL OF LAND, situate in the Town of Kirkwood, County of Broome, State of New York, and located in Lots Nos. Thirteen and fourteen (13 and 14) of Bingham's Patent, bounded and described as follows: Beginning at a point in the center of the Binghamton to West Colesville Road, which point is the northwest corner of a parcel of land conveyed to George E. Kelly and Mary T. Kelly by Willis C. Jones by deed dated April 30, 1958, and recorded that date in Broome County Clerk's Office in Book 973 of Deeds at page 386; running thence on a course south thirty-seven degrees eleven minutes east (S 37̊ 11' E) along the southwest line of said premises so conveyed by Willis C. Jones to George E. Kelly and Mary T. Kelly, a distance of two hundred fifty (250) feet to a point; thence easterly on a line parallel with the center line of the Binghamton to West Colesville Road a distance of one hundred fifty (150) feet to a point two hundred fifty (250) feet from the centerline of the Binghamton to West Colesville Road measured along a line parallel with the southwest line of the aforesaid premises of George E. Kelly and Mary T. Kelly and one hundred fifty (150) fee therefrom; thence running on a course north thirty-seven degrees eleven minutes west (N 37̊ 11' W) on a line parallel with the first described line a distance of two hundred fifty (250) feet to the center line of said Binghamton to West Colesville Road; thence westerly along said center line of said road a distance of one hundred fifty (150) feet to the point or place of beginning Being a parcel of land one hundred fifty (150) feet front and rear by two hundred fifty (250) feet deep and a portion of the premises conveyed to George E. Kelly and Mary T. Kelly by Willis C. Jones by the said deed dated April 30, 1958, and recorded in Broome County Clerk's Office that date in Book 973 of Deeds at page 386. All courses set forth above are given as the compass pointed in the 1946.
