Under and by virtue of the power of sale contained in that certain Deed to Secure Debt (also known as a Security Deed) from J. OC HWY 17 PROPERTIES, LLC to MJRL Capital, LLC dated September 23,2023 recorded in Deed Book 3207, Pages 25-34, Chatham County, Georgia Records as modified by that certain Modification of Deed to Secure Debt recorded in Deed Book 3487 Pages 386-392 Chatham County Records and thereafter modified by a Second Modification of Deed to Secure Debt recorded in Deed Book 3644, Pages 231-237, Chatham County Records (collectively the "Deed To Secure Debt"), , the undersigned will sell at public outcry to the highest bidder for cash between the hours of 10:00 a.m., and 4:00 p.m. on the first Tuesday in October being October 7,2025 at the Savannah Civic Center 301 W. Oglethorpe Avenue, Savannah, GA 31401, specifically in the Bryan Meeting Room on the second floor the following described property (the "Property"):
Parcel I:
All that certain lot, tract or parcel of land situate, lying and being in Chatham County, Georgia known and designated as Lots One (1) and Two (2) Stokes Subdivision, a subdivision of a portion of Lot Five (5) Saranac, 7th G.M. District, Chatham County, Georgia, according to a map or plan of said subdivision dated May 3rd, 1976, prepared by Vincent Helmly for R. H. Stokes recorded in the office of the Clerk of Superior Court of Chatham County, Georgia, in Subdivision Map Book P, Page 62; said lots being bounded generally on the south by Cottonvale Road, on the west by Ogeechee Road (U.S. Highway 17), on the North by the property of Kermit Ray Fetty, and on the east by the property of Richard E. North and Marjorie North; for a more particular description of said parcel of land and its exact metes and bounds, express .reference is hereby made to the aforesaid recorded map or plan of said subdivision, which, by this reference is incorporated herein and made a part hereof.
LESS AND EXCEPT any portion of the property conveyed to the Department of Transportation by that Order and Judgment .in the Superior Court of Chatham County, Georgia, Docket No. CV00-0547-BA, dated May 12, 2000, and recorded in Deed Book 212E, page 12, Chatham Comity, Georgia records.
Parcel II:
All that certain lot, tract or parcel of land situated, lying and being in the 7th G.M. District of Chatham County, Georgia, and being a portion of the Southwestern portion of Lot Number Five (5), Saranac, the map of which is recorded in Map Book 2, Folio 60, in the Office of the Clerk of Superior Court of Chatham County, Georgia, the property hereby conveyed being more particularly described as follows:
Commencing at the point where the Easterly right of way line of U.S. Highway 17 (Ogeechee Road) intersects with the Northerly right of way line of Cottonvale Road, and running along the Northerly right of way line of Cottonvale· Road a distance of 154 feet, more or less, to the point on Cottonvale Road where the lands of Sanks adjoin the lands of Mason, which is the Point of Beginning, which said Point of Beginning was formerly shown as being 198.12 feet from the above intersection of U.S. Highway 17 (Ogeechee Road) and Cottonvale Road on the plat recorded in Plat Record Book 12-P, Folio 34, prior to the widening of said Ogeechee Road, which plat is made a part hereof by express reference; thence from said Point of Beginning North 44°20'30" East a distance of 191.90 feet to a point; thence South 57°24'30" East a distance of 137.12 feet to a point; thence South 44 °34' 10" ·west a distance of 219 .26 feet to a point on the Northerly right of way line of Cottonvale Road; thence North 46°04' 14" West along the Northerly .right of way line of Cottonvale Road a distance of 133.30 feet to the Point of Beginning, all of which will appear by reference to the plat of survey prepared by Carl R. Jackson, dated October 20, 2003, and recorded in Plat Record Book 26-P, Folio 46, in the aforesaid Chatham County, Records.
The indebtedness secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, nonpayment of the indebtedness as and when due. The Property will be sold subject to: (1) all outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable); (2) matters that would be disclosed by an accurate survey and inspection of the Property; (3) any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and easements, if any, superior to the Security Deed; and (4) rights of tenants in possession, if any.
The sale will be conducted for the purpose of paying the amounts due on the secured indebtedness, including principal, interest, late charges, fees, expenses of sale, and all other sums provided in the Note and Security Deed, and will be made subject to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and to final confirmation and audit of the status of the loan with the Secured Creditor.
To the best of the undersigned's knowledge and belief, the party in possession of the Property is J. OC HWY 17 PROPERTIES, LLC or a tenant or tenants.
The following law firm has been designated as the entity with full authority to negotiate, amend, and modify all terms of the mortgage with the debtor pursuant to O.C.G.A. § 44-14-162.2; provided, however, that such an entity is not required by law to negotiate, amend, or modify the terms of the loan:

Said Property will be sold as the property of J. OC HWY 17 PROPERTIES, LLC subject to prior liens, encumbrances, and assessments, if any, to the highest bidder for cash, and the proceeds will be applied to the payment of said indebtedness and the expenses of sale as provided in said Deed to Secure Debt and by law.
