Under and by virtue of that Power of Sale contained in Article V, Section 8 of that certain Master Declaration of Covenants, Conditions and Restrictions, Southbridge dated December 29, 1987 and recorded at Deed Book 137F, Page 261, in the records of the Office of the Clerk of the Superior Court of Chatham County, Georgia together with all amendments, modifications, supplements and restatements thereof (hereinafter collectively referred to as the "Declaration") granted unto the Southbridge Homeowners' Association, Inc., a Georgia non-profit corporation ("Southbridge"), and due to the failure to pay lawfully imposed assessments levied against the below described property, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Chatham County, Georgia within the legal hours of sale on the first Tuesday in February 2026, the following described property:
ALL that certain lot, tract or parcel of land situate lying and being in the State of Georgia, County of Chatham and City of Savannah, being known and designated as Lot 427, Southbridge Subdivision, Phase 12-B, as shown upon a map or plan of Southbridge, Phase 12-B, a portion of land formerly of Timberlands Associates as prepared for Hall Development Co., by Thomas and Hutton, RLS#2282, dated March 3, 1997 and recorded in the Office of the Clerk of the Superior Court of Chatham County, Georgia in Subdivision Map Book 16-S, Folio 92. Express reference is hereby made to said Subdivision Map for better determining the metes, bounds and dimensions of the property herein conveyed.
This being the same property conveyed by Warranty Deed dated March 22, 2001 from Genesis Designer Homes, LLC to Minesh M. Patel and Bhavisha M. Patel and recorded in the Office of the Clerk of Superior Court of Chatham County, Georgia in Deed Record Book 220-B, Page 199.
Being the same property conveyed by Warranty Deed dated March 15, 2011 from Minesh M. Patel and Bhavisha M. Patel to Frank Howard Bynes, recorded March 18, 2011 in said Clerk's Office in Deed Record Book 368-L, Page 596.
Being the same property conveyed by Survivorship Deed dated April 1, 2011 from Frank Howard Bynes to Frank Howard Bynes and Gayle Elizabeth Bynes, recorded April 4, 2011 in said Clerk's Office in Deed Record Book
The debt secured by the Declaration which totals Eleven Thousand, One Hundred Forty-Three and 21/100 Dollars ($11,143.21) has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided for in the Declaration. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale as provided in the Declaration and by law, including reasonable attorney's fees as provided in the Declaration.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien but not yet due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants and any matters of record including but not limited to, those superior to the Declaration first set out above. Said property will be sold on an "as-is" basis without any representation, warranty or recourse against the above-named or the undesigned.
Southbridge Homeowners' Association, Inc., a Georgia non-profit corporation, is the governing authority authorized to impose assessments and affect remedies for non-payment thereof as provided in Article V, Section 8 of the Declaration.
The entity which has full authority to negotiate, amend, and modify the payment terms with the owner(s) of the subject property is Southbridge Homeowners' Association, Inc., c/o Mark A. Bandy, the Law Offices of Mark A. Bandy, P.C., 340 Eisenhower Dr., Ste. 800, Savannah, Georgia 31406, 912-509-7015.
NOTE HOWEVER, that such entity is not required by law to negotiate, amend or modify the payment terms.
To the best knowledge and belief of the undesigned, the party in possession of the property is Frank Howard Bynes and/or Gayle Elizabeth Bynes or a tenant or tenants and said property is more commonly known as 20 Amberwood Circle, Savannah, Georgia 31405. Should a conflict arise between the property address and the legal description, the legal description will control.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of total amounts owed.
