By virtue of Execution 2563CV000032 issued by the Gardner District Court wherein, A&M Construction Services, LLC named Judgment Creditor(s) having assigned the same unto James Xarras rendered against Alexis X. Curry aka Alexis X. Hachey aka Alexis Hachey as Trustee of the Apple Tree Realty Trust named Judgment Debtor(s), on the 22nd day of June in the year 2026, having levied upon seized and taken all the right, title and interest which the said Alexis X. Curry aka Alexis X. Hachey aka Alexis Hachey as Trustee of the Apple Tree Realty Trust had in and to the lands in the town of Lunenburg hereinafter described in Book 03704, Page 168, at the Worcester County Registry of Deeds as follows:

PARCEL I
A certain tract of land, situated in Lunenburg, Worcester County, Massachusetts, near Whalom Lake, bounded as follows:
Northerly by a road sometimes called School Street, being the road formerly leading to Lunenburg over Lowe's Hill, so-called;
Westerly by a road leading from said School Street southerly along the westerly side of said Whalom;
Southerly by Prospect Street;
Easterly by a private way known as Kimball Street.
Said tract includes lots numbered 1 to 32, inclusive on a plan of land for George N. and James S. Proctor, drawn by Charlie H. Davis, C.E., together with the streets shown upon said plan on which said lots abut.
Excepting so much of the above-described property has been conveyed to or taken by the Town of Lunenburg for Highway purposes. Meaning and intending to convey all the above property owned by Whalom Park, bounded by Prospect Street, Pond Street, School Street and Kimball Street in said Lunenburg.
Being the first-described parcel conveyed in a deed from Henry G. Bowen to Whalom Park Amusement Company recorded with Worcester Northern District Registry of Deeds in Book 573, Page 336.
PARCEL II
The land located in the Town of Lunenburg, Worcester North County, Massachusetts on Prospect Street, bounded and described as follows:
THENCE Commencing on the Northwesterly side of Prospect Street at an iron pin;
THENCE South 53º 18' 56" West 15 feet to an iron pin at the shoreline of Lake Whalom;
THENCE Easterly by the shoreline of Whalom Lake, 53 feet to an iron pin;
THENCE North 54º 25' 04" East 15 feet to an iron pin;
THENCE South 55º 07' 00" East 7 feet to an iron pin;
THENCE South 36º 41' 04" East 46 feet to an iron pin and the place of the beginning.
Containing 820 square feet, more or less, as shown on a Plot Plan prepared for Whalom Park Co., Lunenburg, MA 1"=30' January 18, 2001, Szoc Surveyors 32 Pleasant Street, Gardner, MA.
On August 13, 2026, at 10:00am at the Deputy Sheriff's Office located at 240 Main Street, Worcester, MA. I will sell said right, title and interest at public auction, for cash, to the highest bidder, together with all costs and fees thereon. Said sale of land is subject to any and all encumbrances of record.
NOTICE REGARDING ON-SITE SEWAGE DISPOSAL SYSTEMS
You are hereby notified that Massachusetts Regulations (Title 5 Regulations) require an inspection of on-site sewage disposal systems when there is a transfer of title to real estate. Any purchaser or transferee of real estate serviced by an (on-site sewage disposal system is obligated to inspect, and if necessary, to upgrade a system in accordance with the provisions of Code of Massachusetts Regulations (CMR). You are hereby referred to 310 CRM 15.300-15.305 for time periods to do so and other requirements.
The office of the Deputy Sheriff has no information about whether the real estate in question is served by an on-site sewage disposal system.
Terms of Sale: Cash, cashiers or certified check in the sum of $5,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder {the plaintiff and its designee(s) are exempt from this requirement}; the highest bidder shall pay $5,000.00 and the balance of purchase price payable in cash, certified or treasurer's check within thirty (30) days after the date of the sale at the office of the deputy sheriff.
