NOTICE OF VESSEL ARREST
NOTICE IS HEREBY GIVEN pursuant to Rules C and E of the Supplemental Rules for Certain Admiralty and Maritime Claims of the Federal Rules of Civil Procedure and Local Admiralty Rule 530 of the United States District Court in and for the Eastern District of California that on the 28th day of January, 2026, the United States Marshal arrested, seized and took into its possession the Defendant Vessel M/V WILD C'S, a 1981 Uniflite Motor Vessel of Approximately 40-Feet in Length and 17-Feet in Beam, U.S. Coast Guard Official No. 635920, and all of her engines, tackle, accessories, equipment, furnishings, and all other appurtenances, in rem, for the causes set forth in the Verified Complaint, to wit: foreclosure of maritime trespass lien by vessel, breach of maritime contract and quantum meruit. This case is pending in Case No. 2:25-cv-02938-AC, VILLAGE WEST MARINA, LLC, dba VILLAGE WEST MARINA & RESORT, a California Limited Liability Company, Plaintiff, v. M/V WILD C'S, a 1981 Uniflite Motor Vessel of Approximately 40-Feet in Length and 17-Feet in Beam, U.S. Coast Guard Official No. 635920, AND ALL OF HER ENGINES, TACKLE, ACCESSORIES, EQUIPMENT, FURNISHINGS, AND ALL OTHER APPURTENANCES, in rem, Defendant, in the United States District Court for the Eastern District of California, at Sacramento.
The amount demanded in the Verified Complaint is $4,995.65, calculated through September 30, 2025, plus prejudgment interest, custodia legis expenses and all other costs of suit.
This arrest was made pursuant to an Order and Warrant for Arrest issued by the Court and the Clerk of the Court on or about October 16, 2025.
Notice is hereby provided to all persons claiming any interest in said DEFENDANT VESSEL, or having anything to say why the same should not be condemned and forfeited, that they must file their claims pursuant to Rule C(6), Supplemental Rules to the Federal Rules of Civil Procedure, with the Clerk of the United States District Court, at Sacramento, and serve a copy of it on attorneys for Plaintiff, BRODSKY, MICKLOW, BULL & WEISS, LLP at 955 Harbor Island Drive, Suite 130, San Diego, California 92101. Answers to the Complaint must be filed and served in accordance with and within the time specified in Supplemental Rule C(6) following the date of publication, and default may be entered and condemnation ordered in the absence thereof.
Motions for intervention under Fed. R. Civ. P. 24 by persons claiming maritime liens or other interests shall be filed and served on the attorney for plaintiff or the plaintiff if appearing in propria persona in accordance with and within the time specified in Supplemental Rule C(6) for filing a claim following the date of publication.
