NOTICE

NOTICE NOTICE IS HEREBY GIVEN that the County Council of Spartanburg County, South Carolina (the "County Council") on March 16, 2026, adopted a Resolution entitled: "A RESOLUTION TO MODIFY THE BOUNDARIES OF STARTEX-JACKSON-WELLFORD-DUNCAN WATER DISTRICT" (the "Resolution"), which authorized the annexation into the boundaries of Startex-Jackson-Wellford-Duncan Water District, South Carolina (the "District") of several parcels (the "Annexed Property") and the removal from the boundaries of the District of several parcels (the "Excluded Property") all as described in the Resolution (the "Boundary Modification"). The County Council unanimously approved the Resolution authorizing the Boundary Modification which included the annexation of the Annexed Property into the District and the removal of the Excluded Property from the District. The Resolution does not authorize the District to issue bonds in connection with the Boundary Modification under Title 6, Chapter 11, Article 3of the Code of Laws of South Carolina, 1976, as amended; however, the County is separately considering an ordinance to authorize the District to issue bonds for several capital improvement projects under the provisions of Title 6, Chapter 11, Article 5 of the Code of Laws of South Carolina, 1976, as amended. No new commission nor any changes to the Startex-Jackson-Wellford-Duncan Water Commission, the governing body of the District, will be made as a result of the Boundary Modification. Any person affected by the action of the County Council may, by action de novo instituted in the Court of Common Pleas of Spartanburg County, within twenty days following the last publication of this notice, but not afterwards, challenge the action of County Council.
