NOTICE THAT COUNTY OF STEUBEN
LOCAL LAW NO. TEN FOR THE YEAR 2026
(PRESENTED AS LOCAL LAW TENTATIVELY
NO. SEVEN FOR THE YEAR 2026)
IS EFFECTIVE IMMEDIATELY UPON PASSAGE
NOTICE IS HEREBY GIVEN that the County of Steuben Local Law No. Ten for the Year 2026, Placing a Six-Month Moratorium on the Issuance of New Biosolid Permits for Spreading in Steuben County, was finally adopted by the County Legislature of the County of Steuben on the 18th day of May 2026, after the holding of a Public Hearing on the 18th day of May, 2026, and is effective upon final adoption.
SAID LOCAL LAW IS FULLY SET FORTH AS FOLLOWS:
SECTION 1. LEGISLATIVE INTENT
The Legislature recognizes for some time the State of New York has become aware of PFAS "forever chemicals" damage to land and drinking water resulting from biosolid field applications. The County Legislature is aware that the NYS DEC is crafting new regulations to curtail the negative effects of biosolid field applications. However, it does not appear that the new rule making of the NYS DEC will be complete within the next 6 months.
The County Legislature finds it appropriate to temporarily restrict the spreading of biosolids to the permits currently issued until the passage of new regulations to be issued by the NYS DEC which may further satisfy the concern the County Legislature has for the lands and waters of Steuben County.
The County Legislature acknowledges the benefit to farmers to have the use of the materials created as a by-product of the solids.
The County Legislature acknowledges the benefit to local municipalities that create such biosolids to allow land application of the biosolids instead of trafficking solids to the landfill.
SECTION 2. RESTRICTING THE SPREADING OF BIOSOLIDS IN STEUBEN COUNTY
Application of biosolids in Steuben County shall be restricted to already issued permits and application shall exclude municipal permits issued by the NYS DEC. Further, that no new permits be issued for new land application for the 6 months following this law without the NYS DEC approving new regulation.
SECTION 3. EFFECTIVE DATE
The within Local Law shall become effective immediately upon passage.
THIS NOTICE OF THE EFFECTIVE DATE OF THE ABOVE COUNTY OF STEUBEN LOCAL LAW NO. TEN FOR THE YEAR 2026, in accordance with the applicable provisions of Law, is hereby published in pursuance of Section 214 of the County Law of the State of New York.
