IN THE MATTER OF THE JOINT PETITION OF VEOLIA WATER NEW JERSEY,
INC. AND LAKE LENAPE WATER CO. FOR AUTHORIZATION (I) FOR LAKE
LENAPE WATER CO. TO DISCONTINUE UTILITY SERVICE AND SELL UTILITY
ASSETS; AND (II) FOR VEOLIA WATER NEW JERSEY, INC. TO ACQUIRE
CONTROL OF LAKE LENAPE WATER CO.'S UTILITY ASSETS AND EXPAND ITS
SERVICE AREA RELATED TO THE ACQUISITION OF ASSETS

PLEASE TAKE NOTICE that, on December 19, 2025, Veolia Water New Jersey, Inc. ("Company" or "Veolia") and the Lake Lenape Water Co. ("LLWC") filed a joint petition ("Petition") with the New Jersey Board of Public Utilities ("Board" or "BPU") pursuant to N.J.S.A. 48:2-14, N.J.S.A. 48:2-24, N.J.S.A. 48:2-51.1, N.J.S.A. 48:3-7, N.J.A.C. 14:1-5.5, N.J.A.C. 14:1-5.6, and N.J.A.C. 14:1-5.14, to acquire the water system assets ("Water System") located in the Township of Andover in the County of Sussex (" Township") and to transfer service of the Water System from LLWC to Veolia ("Proposed Transaction"). Specifically, as a result of the asset purchase, Veolia's Petition seeks Board approval of a municipal consent ordinance ("Ordinance No. 2025-17") to provide water service via the Water Systemin the Township, which is currently served by LLWC.
The Township adopted Ordinance No. 2025-17 on November 6, 2025, pursuant to N.J.S.A. 48:19- 17 and N.J.S.A. 48:19-20, granting municipal consent to Veolia to provide water service to the properties served by the Water System in the Township, and to lay, maintain, and relay water pipes, mains, connections, apparatus, and appurtenances beneath and along public roads, streets, alleys, and places as Veolia may deem necessary for the provision of continued water service to the properties.
NO INCREASE IN RATES WILL RESULT FROM APPROVAL OF THE PETITION. If
the Petition is approved, there will be no rate changes implemented by the Company as a result of the Board's approval of the Petition, and therefore rates will remain the same.
PLEASE TAKE FURTHER NOTICE that a virtual public hearing on the issue of the Municipal Consent has been scheduled for August 4, 2026, at 10:00am, which will be presided over by Commissioner Rebhorn (or a hearing officer designated by the Board). Members of the public are invited to listen to the hearing and express their views on the Petition by joining via video conference at the designated date and time using the following link or dial-in number:
