Zoning Board of Adjustment
TAKE NOTICE that on the 6th day of August, 2026, at 6:00 pm, a hearing will be held before the City of Millville Zoning Board of Adjustment in the 4th Floor Richard C. McCarthy Commission Chamber, 12 S. High Street, Millville, New Jersey, on the application of the undersigned for a variance or other relief so as to permit:
The operation of a convenience store. Formerly used as a candle store, the property is a prior existing nonconforming use. Applicant intends to incorporate limited eat-in/take-out food services. Applicant seeks a D variance, and any other necessary variances and applications. A hearing had previously been held on February 5, 2026, at which time the current variance application failed to receive sufficient votes to be approved. Applicants thereafter filed an appeal captioned Asim Javaid and Babar Boota vs. City of Millville Zoning Board of Adjustment, in the Superior Court of New Jersey, Law Division, Cumberland County, with Docket Number CUM-L-000274-26. The above court case was resolved by Consent Order dated July 1, 2026, directing that the matter be remanded to the Zoning Board of Adjustment for the City of Millville for reconsideration by the Board. The reconsideration is to be based upon (a) the record of the hearing conducted on February 5, 2026; and (b) new testimony by the Plaintiffs and/or Plaintiiffs' witnesses regarding the Board's stated concerns about the potential negative impacts of the requested variance. The Consent Order further directed that the Board consider whether certain conditions of approval may mitigate or alleviate any potential negative impacts of the requested variance. The Board was further directed to prepare a resolution setting forth the Board's findings of fact and reasons for either granting or denying the application after reconsideration. The Court further directed that the aforesaid be accomplished by September 30, 2026. The Consent Order further provided that the above court action was dismissed without prejudice and without an award of fees and costs to either side.
