NOTICE TO BIDDERS
CAD CELL NO. 2 CONTAINMENT BERM & LOWER HARBOR CAD CELL BERM REPAIRS
NEW BEDFORD, MA
The New Bedford Harbor Development Commission, d.b.a. New Bedford Port Authority (NBPA), is soliciting bids for CAD CELL NO. 2 CONTAINMENT BERM & LOWER HARBOR CAD CELL BERM REPAIRS.
Sealed bids will be received by the NBPA, at 123 MacArthur Drive, New Bedford, MA, 02740, between 8AM-5PM, M-F, until the date and time of the Bid Opening.

Invitation for Bid (IFB) documents are available by contacting Beth Schuh at: beth.schuh@foth.com, with subject: "NBPA-FY26-002: IFB REQUEST" on or after FEB. 25, 2026.
A non-mandatory Pre-bid Conference and Inspection Tour will be held at the NBPA office at 123 Mac Arthur Dr., New Bedford, MA, on MARCH 4, 2026, at 11AM.
All inquiries and questions must be submitted to beth.schuh@foth.com, by MARCH 11, 2026, at 5PM. Answers to all questions will be posted in an addenda and e-mailed to all IFB recipients.
Supplies furnished as part of this Contract are exempt from Sales and Use Tax, and all labor must comply with current prevailing state wage rates. The project is partially funded with federal funds from MassWorks and USEPA and subject to federal Davis-Bacon minimum wage rates as determined by the USDOL including all regulations and requirements as stimulated by this funding authority. All bids should take these factors into consideration and be calculated accordingly. The project is also subject to the Buy American Act, 41 U.S.C. chapter 83.
Bidding procedures and the award of the Contract and Subcontracts will be in accordance with the provisions of Chapter 30, Section 39M of the General Laws of the Commonwealth of MA. The project will be awarded to the lowest eligible, responsible, and responsive bidder within 15 days after Bid Opening. The time for award may be extended by mutual agreement between NBPA and the apparent lowest eligible, responsible, and responsive bidder.
Bidders must submit a 5% bid deposit with their bid. The selected Contractor must furnish a Performance Bond for 100% and a Payment Bond for 50% of the Contract price.
Bidder must complete the instructions for filing bids included in the IFB and furnish all required forms with their bid.
NBPA reserves the right to cancel this procurement at any time before a Contract is executed and approved, in which event NBPA will reject all submissions received in response to the IFB. NBPA is an EOE/AA/ MBE/WBE employer.
