The Village of Biron, in accordance with the Wisconsin Department of Natural Resources (WDNR) Safe Drinking Water Loan Program (SDWLP) Disadvantaged Business Enterprise (DBE) requirements, hereby notifies all bidders that Disadvantaged Business Enterprises (DBEs); including Minority Business Enterprises (MBEs) and Women's Business Enterprises (WBEs), are strongly encouraged to submit bids and to participate in the performance of this contract.
This notice is published as part of the Village of Biron's good -faith effort to ensure nondiscrimination and equal opportunity in contracting.

BIDDERS MUST SUBMIT BIDDING PROPOSALS NO LATER THAN 11 A.M. LOCAL TIME TUESDAY, MARCH 10, 2026, to the Wisconsin Department of Transportation, Division of Transportation System Development, for the highway work hereinafter described. Bidders must either submit electronic bids on the internet through the Bid Express™ on-line bidding exchange or submit sealed bidding proposals on the day of the bid opening to 4th Floor South, Room S437 Hill Farms State Transportation Building 4822 Madison Yards Way Madison, Wisconsin. The results of the bidding proposals received will then be published at 1 2 P . M . on Wednesday, the day after the letting.
Bidders wishing to submit sealed bidding proposals by mail to the Bureau of Project Development may do so at their own risk. The correct street address for mailing and/or shipping is: Wisconsin Department of Transportation, Division of Transportation System Development, 4th Floor South, Room S437 Hill Farms State Transportation Building 4822 Madison Yards Way Madison, Wisconsin, 53705. Bidders wishing to submit their sealed bidding proposals in person prior to the day of the bid opening shall submit them to the Bureau of Project Development, 4th Floor South, Room S437 Hill Farms State Transportation Building 4822 Madison Yards Way Madison, Wisconsin. The Bureau of Project Development will not open and will return all sealed proposals received later than the time identified above.
ELECTRONIC BIDDING

PROPOSAL GUARANTY
With each proposal, the bidder shall include a properly executed bid bond or a cashier's check, certified check, bank check, or postal money order in the amount designated in the Highway Work Proposal made payable to the Wisconsin Department of Transportation. Certified checks shall be drawn on the account of the bidder submitting the proposal. The bidder may also satisfy the proposal guaranty requirements by having a properly executed annual bid bond on file with the Department.

PLAN HOLDERS AND ELIGIBLE BIDDERS
To request to be listed as a Plan Holder or Eligible Bidder, you must submit a completed DT1633 form using the online proposal request application and users guide. The form must be completed and submitted no later than 11:45 a.m. on the last business day preceding the letting.

QUALIFICATIONS OF BIDDERS
Unless otherwise specified in this advertisement, the Department will issue bidding proposals only to those who have established their qualifications for the work to be bid upon. Any prospective bidder who has not established their qualifications must file a sworn statement with the Department not less than TEN business days prior to the time set for submitting bidding proposals on a form furnished by the Department. The Department will evaluate this statement and will issue biding proposals as it deems warranted.
HOURS OF LABOR AND MINIMUM WAGE RATES
Pursuant to regulations provided by applicable federal and/or state laws, the hours of labor and minimum wage rates are set forth in the bidding proposals.
AFFIRMATIVE ACTION
The Wisconsin Department of Transportation, in accordance with Title VI of the Civil Rights Act of 1964 (42 U.S.C. §§ 2000d to 2000d-4) and the Regulations, hereby notifies all bidders that it will affirmatively ensure that any contract entered into pursuant to this advertisement, disadvantaged business enterprises will be afforded full and fair opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, or national origin in consideration for an award.
AFFIDAVIT OF NON-COLLUSION
Each bidder shall file a sworn statement executed by or on behalf of the person, firm, association, or corporation submitting the bid, certifying that such person, firm, association, or corporation has not, either directly or indirectly entered into any agreement, participated in any collusion, or otherwise taken any action in restraint of free competitive bidding in connection with the submitted bid. If the bidder fails to submit this sworn statement with the bid, the bidding proposal is irregular, and the Department will reject it.
For electronic bids submitted on the Internet, the bidder must satisfy the affidavit of non-collusion requirements by properly completing and submitting their bid through the Bid Express™ on-line bidding exchange.
For sealed proposals, the bidder must satisfy the affidavit of non-collusion requirements by signing the cover of the bidding proposal and having it properly notarized.
