NOTICE TO PROPERTY OWNERS
Notice is hereby given that the City Council of the City of Johnston, Iowa intends to construct major sanitary sewer facilities in specified areas throughout the City, and has caused to be placed on file for public inspection in the office of the City Clerk a proposed connection fee ordinance establishing the Highway 141 / NW Saylorville Drive Area Sanitary Sewer Connection Fee District, pursuant to which ordinance a connection fee would be imposed upon the owners of properties within said District who make application to connect their properties to the sanitary sewer utility of the City.
The City Council will meet at 7:00 P.M on the 20th day of October 2025, at the Council Chambers, City Hall, 6221 Merle Hay Road, Johnston, Iowa, at which time a public hearing will be held on the proposed connection fee ordinance.
Written comments on this proposal may also be submitted prior to the hearing. All comments submitted no later than 3 PM the day of the meeting shall be made part of the hearing.
The owners of properties within the proposed Sewer Connection Fee District or any other person having an interest in said matter, may appear and be heard for or against the boundaries of the proposed Sewer Connection Fee District, or the proposed connection fees. A property owner will be deemed to have waived all objections unless at the time of the hearing the property owner has filed objections with the City Clerk.
Description of Improvements Constructed
The improvements are known as the "Little Beaver Creek Sanitary Sewer Extension Segments 2A, B and C" (hereinafter referred to as the "Project") and consist generally of the following:
Installing an estimated 16,251 lineal feet of gravity trunk sewer with a diameter ranging from 8-inches to 30-inches, 3,520 lineal feet of sewer force main and 2 lift stations and associated improvements.
General Description of Sewer Connection Fee Districts
A copy of the proposed ordinance establishing the Highway 141 / NW Saylorville Drive Area Sanitary Sewer Connection Fee District, outlining the connection fee for the Connection Fee District has been placed on file for public inspection in the office of the City Clerk. A map of the proposed Sewer Connection Fee District, identifying the specific lots and parcels included within the District, is also available for inspection in the office of the City Clerk. The description of the District set forth below is qualified in its entirety by reference to the foregoing ordinance and map.
The area to be known as the Highway 141 / NW Saylorville Drive Area Sanitary Sewer Connection Fee District, means an area described as follows:
Parts of Sections 8, 9, 16, 17, 20, 21 and 28 of Township 80 North, Range 25 West of the 5th P.M., more particularly described in the proposed ordinance and map on file and available for public inspection in the office of the City Clerk.
Connection Fee
Property owners within the proposed Highway 141 / NW Saylorville Drive Area Sanitary Sewer Connection Fee District will be eligible to connect to the sanitary sewer utility upon application and approval thereof and payment of the connection fee herein described.
A connection fee may include the equitable cost of extending the utility to the properties, including reasonable interest from the date of construction to the date of payment. All fees collected under this subsection shall be paid to the city treasurer. The moneys collected as fees shall only be used for the purposes of operating the utility, or to pay debt service on obligations issued to finance improvements or extensions to the utility.
The connection fee for property owners served by the sanitary sewer facilities as part of the proposed project shall be $5,500 for Connections made by July 1, 2027. This fee will increase 2.7% each year thereafter.
The sewer connection fees are in addition to, and not in lieu of, any other fees for Connection required under the plumbing code, other provisions of the municipal code, or City policy. The property owner paying a connection fee will be responsible for the full cost of providing any necessary sanitary sewer extensions or service lines from the private property improvements or buildings to the trunk sewers being constructed as part of the Project.
Any unauthorized connection(s) to the Highway 141 / NW Saylorville Drive Area Sanitary Sewer Connection Fee District will constitute a municipal infraction pursuant to Chapter 3 of the City Code.
This notice is given by authority of the Council of the City of Johnston, Iowa as provided in Section 384.38(3) of the Code of Iowa, 2025, as amended.
