NOTICE TO THE PUBLIC
YOU ARE HEREBY NOTIFIED that on October 7, 2025, at 10:30 a.m., at the Augusta-Richmond County Judicial Center, 735 James Brown Blvd., Augusta, Georgia 30901, Courtroom Number 2C, Judge Lyons of the Superior Court of Richmond County will hear the case of STATE OF GEORGIA vs. AUGUSTA-RICHMOND COUNTY COLISEUM AUTHORITY and AUGUSTA, GEORGIA, Civil Action File No. 2025RCCV00801, in the Superior Court of Richmond County, the same being a proceeding to confirm and validate the revenue bond designated "Augusta-Richmond County Coliseum Authority Revenue Bond (Augusta Entertainment Complex Project), Federally Taxable Series 2025" (the "Bond"), in the original principal amount of $11,183,000, to be issued for the purpose of refunding the Authority's Revenue Bond (Augusta Entertainment Complex Project), Series 2021, dated January 21, 2021 and maturing on October 1, 2040 (the "Refunded Bond"), presently outstanding in the principal amount of $10,945,000, in order to refinance a portion of the costs of acquiring, constructing, and installing the multi-use coliseum and civic center type facility known as the "Augusta Entertainment Complex," and financing related costs and necessary expenses incidental thereto. In such proceeding the Court will also pass on the validity of the security for the payment of the Bond, which consists of the Intergovernmental Service Agreement (the "Contract") between the Augusta-Richmond County Coliseum Authority (the "Authority") and Augusta, Georgia (the "Consolidated Government"), the Assignment and Security Agreement between the Authority and SouthState Bank, N.A. (the "Bond Buyer"), and the Bond Purchase Agreement between the Authority and the Bond Buyer, all proposed to be executed in connection therewith. Under the terms of the Contract, the Consolidated Government (1) will agree to make payments to the Authority in amounts sufficient to enable the Authority to pay the principal of, premium, if any, and interest on the Bond when due, and (2) will agree to levy an annual ad valorem tax on all taxable property located within the territorial limits of the Consolidated Government, at such rate or rates, within the mill limit prescribed by an amendment to Article VII, Section I, Paragraph II of the Constitution of the State of Georgia of 1945 (1980 Ga. Laws 2177 to 2180, inclusive), now specifically continued as a part of the Constitution of the State of Georgia of 1983 pursuant to an Act of the General Assembly of the State of Georgia (1983 Ga. Laws 3870 to 3872, inclusive), or within such greater millage as may hereafter be prescribed by applicable law, as may be necessary to produce in each year revenues that are sufficient to fulfill the Consolidated Government's obligations under the Contract. All questions of law and fact pertaining to the right to issue the Bond and to provide the security therefore will be heard and determined. Any citizen of the State of Georgia residing in Augusta, Georgia, or any person wherever residing who has a right to object, may intervene and become a party to this proceeding.
WAIVER OF PUBLIC ACCOUNTABILITY: NO PERFORMANCE AUDIT OR PERFORMANCE REVIEW UNDER SECTION 36-82-100 OF THE OFFICIAL CODE OF GEORGIA ANNOTATED SHALL BE CONDUCTED WITH RESPECT TO THE BOND.
