NOTICE to Jose Alvarado Cruz RE DE Superior Court Case No. S25J-09-041 CAK
Plaintiff in the above-captioned matter intends to obtain court judgment against Jose Alvarado Cruz ("Cruz") in the Superior Court for the State of Delaware based on a Promissory Note executed by Alpha on February 10, 2025 in the principal amount of $102,614.31, and the Unconditional Personal Guaranty of Jose Alvarado Cruz, also executed on February 10, 2025, in the amount of $53,671.38, calculated as follows, plus court costs and additional interest accruing at a per diem rate of $19.58 beginning September 22, 2025:
a. $51,055.88 in unpaid principal and interest through this date; and
b. $2,615.50 in attorneys' fees and costs;
Plaintiff alleges that defendant, Cruz, has waived his rights to notice and a hearing prior to the entry of judgment against him.
The entry of such a court judgment will result in a lien against all of Cruz's real estate and, in default of payment, the Sheriff can levy against Cruz's personal property and real property and ultimately sell at public auctions his personal property and real property for credit against the debt.
In default of payment in appropriate cases, the Sheriff may seize some portion of wages for credit against the debt.
Cruz may appear in Superior Court, Sussex County, Georgetown, Delaware at 11:00 a.m. on 12/19/2025, at which time he may object to the entry of judgment and a hearing will then be scheduled by the Court. At the hearing, the plaintiff will be required to prove that Cruz has effectively waived his rights to notice and a hearing prior to the entry of judgment.
Cruz is not required to appear, but if it fails to do so, judgment will be entered by default.
