Project Description: Hakes C&D Disposal, Inc., a subsidiary of Casella Waste Systems, Inc., proposes to modify their Solid Waste Management Facility (SWMF) and Air State Facility (ASF) permits issued under Environmental Conservation Law to expand their existing construction and demolition (C&D) debris landfill located at 4376 Manning Ridge Road in the Town of Campbell. This landfill expansion project would add approximately 43.3 acres of new landfill disposal area contiguous to the west of the existing 78.9 acres of disposal area.
The project would also add 21.7 acres to the existing 22.2-acre on-site soil borrow area from which soils are excavated for landfill construction and operation; relocate some facility structures (scale house/ office building, truck scale, maintenance building, and tarping station); construct three new stormwater ponds; modify two existing stormwater ponds and the on-site leachate transfer and storage system; and enlarge the landfill gas management/treatment system. Additionally, Manning Ridge Road would be realigned to the west of the expanded landfill footprint to accommodate the expansion project.
The application proposes an alternative landfill liner design pursuant to the State solid waste management facility regulation at 6 NYCRR 363-6.6(b) and includes an "alternative liner demonstration" based, in part, on groundwater data, site geology consisting of low permeability soils, cell design including slopes of 10% or more and a groundwater suppression system, and the nature of C&D debris waste. The proposed alternative design for the expansion consists of a double composite liner system in the lower part of the disposal area and a single composite liner in the upper area of the disposal area. Also, the application proposes that the New York State Department of Environmental Conservation ("NYSDEC") grant a variance from 6 NYCRR Part 363-6.7(a)(2)(i) for the project. The variance would allow the lower two-thirds of the 24-inch- thick compacted clay liner to contain particles up to three-inches in diameter, instead of one-inch in diameter.
NYSDEC has prepared a draft ASF permit which is available for public review with the other permit application materials for the project. If issued, the draft ASF permit would authorize the construction and installation of a new 900 cfm (cubic feet per minute) enclosed flare to control landfill air emissions. The existing flare at the landfill would remain on-site as backup. The draft ASF permit would require quarterly methane surface scans for one year, at minimum, with an action level of 200 ppm (parts per million).
The existing maximum permitted landfill height of 1829 feet, the approved design capacity of the landfill (disposal rate) set at 1494 tons per day, and the traffic route for waste haulers would remain the same for the landfill expansion project. The applicant also submitted applications to renew the SWMF and ASF permits. DEC is processing these renewal applications concurrently with the permit modification applications for the project which are the subject of this Notice.
Pursuant to the requirements of Section 7(2) of the Climate Leadership and Community Protection Act (CLCPA), the Department has requested and received information regarding the project's consistency with CLCPA.

State Environmental Quality Review (SEQR) Determination: The project is a Type I Action, as designated by 6 NYCRR § 617.4(b)(6)(i). NYSDEC, acting as Lead Agency pursuant to SEQRA, issued a Positive Declaration and Draft Scoping Document on September 15, 2021. The Scoping Document was finalized on April 18, 2022. A draft supplemental environmental impact statement (DSEIS) was accepted for public review and comment on October 8, 2025. As noted further below, written public comments will be accepted on the DSEIS until November 24, 2025. In addition, pursuant to 6 NYCRR § 617.9(a)(4), NYSDEC has determined to hold a public hearing to accept comments on the DSEIS, the details of which are provided below in the public comment hearing section of this notice.
Notice of Complete Application: The NYSDEC has determined that the Solid Waste Facility Management and Air State Facility permit applications filed for the project are complete for purposes of further NYSDEC review and public comment pursuant to 6 NYCRR 621.7.
State Historic Preservation Act (SHPA) Determination: Based on a review of project information, the New York State Office of Parks, Recreation, and Historic Preservation has determined that the project will have no impact on cultural resources in or eligible for inclusion in the State and National Registers of Historic Places. In accordance with SHPA, no further review is required.
Coastal Management: This project is not located in a Coastal Management Area and, therefore, is not subject to the Waterfront Revitalization and Coastal Resources Act.
DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29): This project is not located within or near a potential environmental justice area designated by the DEC and, therefore, it has been determined that the proposed action is not subject to the DEC Commissioner's policy on Environmental Justice (CP-29).
Opportunity for Public Comment: Any interested person may submit comments on the DSEIS, draft ASF permit and application materials at the hearing, and in writing to the DEC Contact Person listed below by November 24, 2025. Comments sent by regular mail must be post- marked no later than November 24, 2025. E-mail and Fax comments must be received by 4:45 p.m. (EST), November 24, 2025.

Public Comment Hearing: Persons wishing to comment on the permit applications, draft ASF permit or DSEIS will have the opportunity to make a statement at two public comment hearings. Two virtual public comment hearing sessions will be held before an Administrative Law Judge (ALJ). The virtual hearing sessions will be conducted electronically via the Webex Webinar platform as indicated below. Hearing participation is available to the public by telephone or internet; see further explanation below. Depending on the number of speakers, the ALJ may need to limit the length of comments to three minutes per speaker to allow everyone an opportunity to speak.
