The proposed action will result in the incidental take of Timber rattlesnake (Crotalus horridus), a NYS-listed threatened species, through the temporary disturbance of 0.98 acres of permanent disturbance of 0.50 acres within area considered to be occupied habitat for foraging and summer use. Net conservation benefit will be reached through the implementation of the mitigation plan, including timing of construction activities and subsequent maintenance activities, use of a NYS-licensed Timber rattlesnake monitor, monitoring plan for drilling activities, use of an education and encounter plan, surety bond, post construction population monitoring plan and restoration and habitat improvement.
