Project Description: The applicant, Orange and Rockland Utilities, Inc., (ORU) has applied for an Article 11 Incidental Taking Permit for activities associated with the replacement of Structures 11, 11.5, 12, and 14 of Transmission Line 31, access road repair and improvement, and temporary access and staging area. The proposed action will result in the incidental take of Timber rattlesnake (Crotalus horridus), a NYS-listed threatened species, through the temporary disturbance of 0.98 acres of permanent disturbance of 0.50 acres within area considered to be occupied habitat for foraging and summer use. Net conservation benefit will be reached through the implementation of the mitigation plan, including timing of construction activities and subsequent maintenance activities, use of a NYS-licensed Timber rattlesnake monitor, monitoring plan for drilling activities, use of an education and encounter plan, surety bond, post construction population monitoring plan and restoration and habitat improvement.

State Historic Preservation Act (SHPA) Determination: Evaluation using a Structural-Archaeological Assessment Form or other information has concluded that the proposed activity will not impact registered, eligible or inventoried archaeological sites or historic structures.
DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29): It has been determined that the proposed action is not subject to CP-29.
