Take Notice that an application for a Freshwater Wetlands General Permit No. 11, Freshwater Wetlands Transition Area Waiver for Redevelopment, Flood Hazard Area Verification, Flood Hazard Area Individual Permit, and Upland and In-Water Waterfront Development Individual Permits has been submitted to the New Jersey Department of Environmental Protection, Division of Land Resource Protection for the redevelopment project described below.

PROJECT DESCRIPTION: The proposed redevelopment project includes the construction of two warehouses with a combined footprint of approximately 850,950 SF, and associated loading docks, trailer parking spaces, and car parking spaces. Associated site improvements include internal access drives, utilities, landscaping, stormwater, and lighting improvements. Offsite improvements include the construction of two stormwater outfalls to an unnamed tributary to the Rahway River on Lot 13, improvement of one stormwater outfall to an unnamed tributary to the Arthur Kill on Lot 6, extension of a sanitary sewer line on Lot 21, and minor grading work on Lot 13. In addition, the current site owner, Phillips 66 Company, will retain the southeastern portion of Lot 10 for continued operation of their facility on a limited basis.
Redevelopment activities are proposed within the tidal flood hazard area and upland waterfront development area onsite and minor disturbances are proposed in tidal and freshwater wetlands and below the mean high water line of tidal waters for stormwater outfall improvements. In addition, previously developed wetland transition areas will be redeveloped with the project. As such, the project requires authorization under the above-referenced permits, pursuant to the Coastal Zone Management Rules (N.J.A.C. 7:7), the Freshwater Wetlands Protection Act Rules (N.J.A.C. 7:7A), and the Flood Hazard Area Control Act Rules (N.J.A.C. 7:13).
A complete copy of the application package is available to be reviewed at either the municipal clerk's office in the municipality subject to this application, or by appointment at the Department's Trenton Office. The Department of Environmental Protection welcomes comments and any information that you may provide concerning the proposed development and site.
