NOTICE
PLANNING BOARD OF THE TOWNSHIP OF MINE HILL
PLEASE TAKE NOTICE that a public hearing will be held before the Planning Board of the Township of Mine Hill at the Municipal Building, 10 Baker Street, Mine Hill, New Jersey 07803 on Monday, March 2, 2026, at 7:00 P.M., to consider the application of the undersigned SMSUR, LLC ("Applicant") for preliminary and final site plan approval, and for bulk and use variances and design waivers from the terms and provisions of the Mine Hill Zoning Ordinance in order to permit the Applicant SMSUR, LLC to use the property as a used car dealership, with commercial and residential use being made of the existing building on the subject property.
The Applicant seeks variances from the Mine Hill Zoning Ordinance for the following pre-existing conditions: from section 310-172D7 for lot coverage, where 65% is permitted and 90.3% is existing; from section 310-172D2 for lot width, where 100 feet is required and 95.28 feet is existing; from section 310-172D4 for side yard setback for accessory structure, where 10 feet is required and 1.3 feet is existing; from sections 310-156 and -157 for buffer from residential properties, where a total of 50 feet between structures on the two properties, including 25 feet on the commercial property, is required and where less than 25 feet is provided on the subject commercial property; and from sections 310-172A and 172B, for a use variance to continue to use the structure on the property for residential use, where such use is not permitted in the "C" Commercial zone district; and the Applicant seeks relief for any other non-conforming conditions, and for any and all other variances, waivers, exceptions, permits, approvals, and other deviations that are otherwise required or deemed necessary by the Planning Board of Mine Hill for approval of the Applicant's application.
The property which is the subject of this hearing is known as 217 Route 46, Mine Hill, and it is designated on the Mine Hill tax maps as Block 802, Lot 9. The property is located in the Commercial "C" Zone of the Township of Mine Hill.
At the hearing, or at any adjournment thereof you may appear in person or by an Attorney to give evidence and make a statement for or against the application, and any person affected by this application will have the opportunity to be heard at this hearing, all in accordance with the Rules of the Mine Hill Planning Board.
All maps, documents and other materials relating to this application are on file and available for public inspection between the hours of 9:00 AM and 4:30 PM, Monday through Friday in the office of the Planning Board Administrator in the Municipal Building, 10 Baker Street, Mine Hill, New Jersey 07803.
