Civil Action File No. ESTATE OF RUTH MUCKELSTON, RESPONDENT PETITION TO HAVE TITLE BY DESCENT DECLARED COMES NOW, PATRICIA HOGAN, Petitioner, by and through his undersigned counsel, and submits this Petition to Have Title by Descent Declared, as follows: RUTH MUCKELSTON ("Decedent") died in Richmond County, Hephzibah on November 6, 2022, as reflected in the death certificate attached hereto as Exhibit 1 and hereby incorporated by reference.Decedent died without a Last Will and Testament.Decedent was predeceased by her husband, RONALD MUCKELSTON on November 15, 2019, as reflected in the certified death certificate attached hereto as Exhibit 3, and was not remarried.At the time of Decedent's death, Decedent owned real property known as 3004 Grey Fox Drive, Hephzibah, Richmond County, GA 30815 (the "Property"), by rights of survivorship with her predeceased husband.A true and correct copy of the last known stamped, filed deed transferring the Property to Decedent and her predeceased husband, jointly with rights of survivorship, is attached hereto as Exhibit 2 and hereby incorporated by reference.At the time of Decedent's death, Decedent was a widow having only one child born or adopted to her, to wit, Patricia Hogan.Petitioner is Decedent's daughter.Petitioner over the age of eighteen (18) years and of sound mind.To the best of Petitioner's knowledge, there are no heirs of a higher degree than Petitioner.Petitioner desires that the Property pass to THE MUCKELSTON REVOCABLE TITLE HOLDING TRUST (the "Trust").In Petitioner's judgment, there is no need for administration upon the estate of Decedent. WHEREFOR, Petitioner respectfully requests that this Court grant Petitioner's Order of Heirship; order a transfer of the registered title of the Property from Decedent to the Trust; and instruct the Clerk of Court to register the transfer of title reflecting the Trust as sole holder of the Property.
