Notice
Pursuant to the Land Recycling and Environmental Remediation Standards Act, the act of May 19, 1995, P.L. 4, No. 1995-2, notice is hereby given that Mr. Mark Dayhoff of 225 E 9th LLC, has submitted to the Department of Environmental Protection a Notice of Intent to Remediate for a site located at 225 E Ninth Street, Borough of Waynesboro, Franklin County, PA. The Site is identified as Franklin County Tax Parcel No. 24-5C48-032-000000 and is comprised of 4.84 acres of land located on the northwestern side of the intersection of Clayton Avenue and E. 9th Street. The Site is currently improved with an approximate 55,000-square foot warehouse style building for non-residential/commercial use.
This Notice of Intent to Remediate states that the Site, recently acquired by 225 E 9th LLC, has been used for industrial manufacturing since the late 1990s and was part of a larger industrial complex that included machine shops, a foundry, and a former manufactured gas plant. Recent environmental investigations associated with the real estate transaction, identified trichloroethylene (TCE), a common industrial solvent, in groundwater and localized soil, from the historical industrial activities in the area. Identified TCE concentrations in groundwater are consistent with a known regional groundwater issue in the area. The new property owner, 225 E 9th LLC, has selected to remediate the TCE in soil and groundwater using the Site-Specific Standard, and they have indicated that the proposed remediation measures will be demonstration of attainment groundwater sampling and exposure pathway elimination. The proposed future use will remain non-residential as a commercial warehouse building.
The Act provides for a 30-day public comment period for site-specific standard remediations. The 30-day comment period is initiated with the publication of this notice. During the 30-day comment period, the Borough of Waynesboro may submit a request to 225 E 9th LLC to develop and implement a public involvement plan involving the municipality in the development of the remediation and reuse plans for the site. Copies of these requests and of any comments should also be submitted to the Department of Environmental Protection at the Southcentral Regional Office, 909 Elmerton Avenue, Harrisburg, PA, 17110.
