Merryman, their beneficiaries, heirs, and assignees You and each of you are hereby notified: This notice is given in relation to the written contract dated September 26, 1959, and executed by Walter Merryman and Caroline C. Merryman, Husband and Wife, as vendors, and Marvin L. Cole and Patricia L. Cole, as joint tenants with full rights of survivorship and not as tenants in common, as vendees, recorded on September 30, 1959, in the office of the Polk County Recorder, recorded in Book 3190 at Page 185; That Patricia L. Cole died on October 17, 2025, and Marvin L. Cole has filed an Affidavit of Surviving Spouse on Mach 4, 2026, in Book 20437 at Page 25 in the records of the Polk County Recorder's office; therefore, Marvin L. Cole is the only remaining vendee on this contract; This notice is given in relation to the foregoing and for the sale of the following described real estate: The South 100 feet of Lot 28 in CAITOL HEIGHTS REPLAT, it being an official replat of Capitol Heights, Polk County, Iowa. NOTICE: You and each of you are hereby notified that, in accordance with Iowa Code § 614.21 and Iowa Land Title Standards 4.12, if a deed is not provided, to the address listed below, within forty-five (45) days of service or an action to foreclose or forfeit the contract has not been commenced within such forty-five (45) day period, the vendee may file an affidavit showing service and compliance with this subsection, Iowa Code § 614.21(4)(b), whereupon the auditor shall correct the county records as provided in section 558.67 to indicate that the rights of the vendor have vested in the vendee.
