Notice of Activity and Use Limitation 12 Jacques Street, Worcester MA Release Tracking Number 2-52781 A release of oil and/or hazardous materials has occurred at this location, which is a disposal site as defined by M.G.L. c. 21E, § 2 and the Massachusetts Contingency Plan, 310 CMR 40.0000. On March 4, 2026, Tolley Turnaround LLC registered with the Worcester South District of the Massachusetts Land Court a Notice of Activity and Use Limitation on the disposal site, pursuant to 310 CMR 40.1070 through 40.1080. The Notice of Activity and Use Limitation will limit the following site activities and uses on a portion of the above property: • Use as a residence, children's school, child daycare facility, or children's recreational area; • Farming, vegetable or fruit gardening, or other agricultural use of soils at or from the Portion of the Property to grow produce for human consumption; and • Uses (other than emergency repair and/or maintenance of utilities) that would involve removal of existing building foundations, pavement, asphalt grindings paving material, and underlying base material, or the upper three feet of soil in unpaved areas, without prompt replacement with similar material which would provide an effective barrier to direct contact with underlying potentially contaminated soils.
