Notice of Adoption of ORDINANCE NO. 197(2025-2026) Notice is hereby given that ordinance No. 197 a summary of which follows, was duly adopted by the City Council of the City of Kelley on April 14, 2026, and will become effective July 1, 2026. AN ORDINANCE ESTABLISHING SOLID WASTE REMOVAL UTILITY Summary Ordinance No. 197. a full copy of which is on file with the City Clerk of the City of Kelley, is an ordinance amending Chapter 105 as stated below: 105.11 Solid Waste Removal Utility established. There is hereby established the Kelley Solid Waste Removal Utility. The city council is the governing body of the utility. The utility shall consist of one district, which shall include all of the area within the corporate limits of the city. The purpose of the utility is to recover the estimated cost of the fees that the city pays for solid waste disposal. 105.12 Rates. Each commercial, industrial, or residential dwelling unit customer shall pay a minimum amount of $2.50 per month. There is no credit or reduction for nonuse. 105.13 Billing. The fees assessed under this chapter shall be collected in conjunction with and in accordance with the utility combined services account as provided in chapter 13.08 of this Code. 105.02 Definitions. As used herein, the following words and phrases have the meaning set out: A "residential dwelling unit" means an individual dwelling unit. For purposes of this ordinance, an apartment or a mobile/manufactured home shall be treated as one unit, and a duplex is two units.
