Notice of Election on Proposition

In accordance with Section 9 of Article XVIII, Ohio Constitution and Ohio Revised Code Section 731.211, notice is hereby given that there will be submitted a proposed amendment to the Charter of the City of Westerville to a vote of the people of City of Westerville at the General Election to be held at the regular places of voting on Tuesday, the 4th day of November, 2025 the question of: ARTICLE XI, SECTION 9 - MUNICIPAL UTILITY METERS AND DATA PRIVACY.
Notwithstanding any other provision of this Charter, (a) At no additional cost to the customer, both electric and water municipal utilities shall provide customers with the option to remove an installed advanced meter, and replace it with a traditional meter that does not emit microwave radiation, or in the event that an advanced meter has not been installed, the option to retain a traditional meter. Ongoing additional fees and charges for customers with traditional meters are prohibited. (1) Electric - Traditional electro-mechanical analog meters that do not emit microwave radiation shall be an option provided to customers and shall be installed no later than 30 calendar days after being requested by the customer. In the event that the utility is unable to supply and install a traditional meter within 30 calendar days, customers shall have the option to supply their own meter. The utility shall test the customer supplied meter at no cost and shall reimburse the customer up to the cost of a new advanced electric meter if the customer supplied meter registers within 2% or less than 2% either fast or slow. Upon presentation to the utility, customer supplied meters registering within the acceptable range shall be tested and installed by the utility within 30 calendar days. Customer supplied meters registering outside the acceptable range shall be promptly returned to the customer. (2) Water - Water meter systems (traditional mechanical water meter bodies, mechanical water meter registers, and wired visual remote meter displays) that do not emit microwave radiation shall be an
option provided to customers and shall be installed no later than 30 calendar days after being requested by the customer. In the event that the utility is unable to supply and install a water meter system that does not emit microwave radiation within 30 calendar days, customers shall have the option to supply their own compatible new water meter system components. The utility shall reimburse the
customer for each component supplied up to the cost the utility would have paid for that component for an advanced water meter system. Upon presentation to the utility, the customer supplied water meter system components shall be installed by the utility within 30 calendar days. (3) Substitute Meters - If traditional meters and meter system components are not available, and the customer chooses not to supply their own, digital electric meters without the capability of emitting microwave radiation and remote water meter touch pads that only transmit a single real-time meter reading to a reading device in close proximity no more than once per month, shall be traditional meter substitutes provided by the utility. (b) Municipal electric and water utilities shall only install advanced meters with written informed consent of the customer. Ultrasonic water meters are prohibited. (c) Municipal utilities shall not share non-aggregated customer data, except for essential business functions or as required by law, without written consent from the customer. (d) If any provision, clause, condition and/or portions thereof of Article XI, Section 9 are determined by a court of
competent jurisdiction to be unconstitutional, invalid, and/or unenforceable for any reason, the same shall not affect in any manner the validity, enforcement and/or constitutionality of any other clause, condition, or portion hereof and the same shall remain in full force and effect. Shall Article XI, Section 9 of the Charter of the City of Westerville be adopted? The polls for the election will be open at 6:30 a.m. and remain open until 7:30 p.m. on election day.
