This matter is before the Court for a Final Hearing. At the call of the case, Plaintiff (hereinafter "Wife") appeared with her attorney, Ashton S. Bowns. Defendant (hereinafter "Husband") did not appear and was not represented by counsel. The bailiff called the Defendant's name three (3) times.
A review of the file shows that Plaintiff filed her Summons and Complaint on June 24, 2024. Plaintiff attempted service upon the Defendant at his last two (2) known addresses and by calling the last known telephone number and telephone numbers of his two (2) sisters as evidenced by the Affidavit of Service filed with the Court on February 11, 2025. Defendant did not respond to the multiple attempts of service. Plaintiff filed a Motion for Service by Publication on February 28, 2025, and Order For Publication was filed on March 5, 2025. Plaintiff ran a copy of the Summons in The Greenville News for three (3) weeks as evidenced by the Affidavit filed with the Court on April 10, 2025. Plaintiff filed an Affidavit of Default on April 28, 2025. Plaintiff filed a Motion to Waive Mediation and Order to Schedule a Default Trial on May 1, 2025. The Court issued an Order granting Plaintiff's Motion to Waive Mediation and Schedule a Default Trial on May 2, 2025.
NACO
Each party shall be subject to a "no adverse contact order" (hereinafter "NACO") which shall restrain each party from engaging, directly or indirectly, in adverse conduct towards the other party. This NACO shall permit the parties to contact, associate and communicate with one another only so long as both parties mutually consent to such contact, association or communication. The purpose of this NACO is to both encourage and require civil contact and communication between the parties, and to prevent unpleasant contact and communication. This NACO is not intended to trigger, implement or effect any provisions of 18 U.S.C. §§ 922(g) (including all subparts) or S.C. Code § 16-25-30 (amended 2015) (including all subparts), nor is the NACO intended to rise to the level of, or be considered, an order of protection as defined in S.C. Code §§ 20-4-10 et seq. No part of this provision shall invoke or be interpreted to invoke any prohibition against the ownership, possession, or use of any type of firearm or ammunition under any federal, state, or local authority. Willful violations of this NACO (including but not limited to inappropriate communications) shall subject the offending party to the contempt powers of the court.
ATTORNEY FEES AND COSTS
2. Wife submitted an Attorney Fees Affidavit which contained fees and costs of $7,746.70. Wife incurred additional fees and costs for the multiple attempts of service by the process server, the filing of a Motion and Order to Publish, and the filing of a Motion and Order to Waive Mediation and Set Trial.
3. This Court hereby orders that Husband should pay Wife's attorney fees and costs of $7,746.70 within ninety (90) days of service of this Court Order.
4. Wife shall publish this Order for three (3) weeks with The Greenville News. An Affidavit of Publication is to be filed with the Court. Upon filing the Affidavit of Publication, Husband will have ninety (90) days in which to pay the Court ordered attorney fees and costs. Husband is to pay the attorney fees and costs of $7,746.70 to Turner Family Law located as 12 E. Stone Avenue, Greenville, South Carolina 29609.
IT IS THEREFORE ORDERED, ADJUDGED AND DECREED as follows:
1. Defendant is in default;
2. Plaintiff is granted a divorce on one (1) years separation;
3. Plaintiff is granted the assets of her vehicle, retirement, and money in any checking account or savings account as listed hereinabove;
4. Plaintiff is responsible for the three (3) credit cards in her name;
5. Defendant is granted the assets of the camper, motorcycle, vehicle, retirement, money in any checking account, or savings account as listed hereinabove;
6. Defendant is responsible for any debt in his name;
7. The parties are to remove the other party from all joint accounts, assets, debts and may request the assistance of the Clerk of Court;
8. The parties are under a NACO as outlined hereinabove; and
9. Plaintiff will file the Final Order of Divorce through publication with The Greenville News for three (3) weeks. After the Affidavit of Publication is filed, Defendant will have ninety (90) days in which to pay Plaintiff's attorney fees and costs of $7,746.70 and this payment is to be made to Turner Family Law, located at 12 E. Stone Avenue, Greenville, SC 29609.
