NOTICE is hereby given that pursuant to a Final Judgment on Plaintiff's Motion for Final Judgment of Foreclosure and for Attorney's Fees and Costs dated the 10th day of September, 2025 in Case Number 2024-CA-1825 of the Circuit Court in and for Leon County, Florida, wherein C. KEVIN FLEMING is Plaintiff, and PEACOCK PROPERTY AND HOLDINGS, LLC a/k/a PEACOCK PROPERTY INVESTMENT HOLDINGS, LLC and UNKNONW TENANT #1 and UNKNOWN TENANT #2 at 3930 Killearn Center Court, Unit 10, Tallahassee, FL, are the Defendants, if the total sum with interest at the rate described in paragraph 13 and all costs accrued subsequent to this judgment are not paid, the Clerk of this Court shall sell the property by public electronic sale at leon.realforeclose.com on October 14, 2025, at 11:00 A.M, Eastern Time, to the highest bidder for cash, except as prescribed in paragraph 4, in accordance with Section 45.031, Florida Statutes, the following described real property, as set forth in the Summary Final Judgment of Foreclosure, to-wit:
Commence at a point of intersection of the Easterly right of way boundary of Capital Circle (100 foot right of way) with the Southerly right of way boundary of Killearn Center Boulevard (80 foot right of way), and run thence North 72 degrees 37 minutes 50 seconds East along said Southerly right of way boundary a distance of 398.42 feet; thence South 12 degrees 01 minutes 20 seconds East 332.72 feet; North 89 degrees 16 minutes 59 seconds East 138.91 feet; thence North 00 degrees 43 minutes 01 seconds West 29.83 feet to the Point of Beginning. From said Point of Beginning run thence North 57 degrees 07 minutes 19 seconds West 44.30 feet; thence North 32 degrees 52 minutes 41 seconds East 15.67 feet; thence South 57 degrees 07 minutes 19 seconds East 44.30 feet; thence South 32 degrees 52 minutes 41 seconds West 15.67 feet to the Point of Beginning.

AT THE TIME OF THE SALE, THE SUCCESSFUL HIGH BIDDER OR BIDDERS, AS THE CASE MAY BE, SHALL POST WITH THE CLERK A DEPOSIT EQUAL TO 5 PERCENT OF THE FINAL BID. THE DEPOSIT SHALL BE APPLIED TO THE SALE PRICE AT THE TIME OF PAYMENT. THE SUM REMAINING DUE AND OWING AFTER APPLICATION OF THE DEPOSIT SHALL BE PAID TO THE CLERK IN CERTIFIED FUNDS IN ACCORDANCE WITH THE POLICY OF THE CLERK OF COURT.

If you fail to file a claim, you will not be entitled to any remaining funds. After 60 days, only the owner of record, as of the date of the Lis Pendens, may claim the surplus.
