UNDER AND BY VIRTUE of the power and authority contained in that certain Order filed on January 20, 2026, in the above-captioned matter and pursuant to applicable law, Substitute Trustee Services, Inc. as Commissioner (the "Commissioner") will place for sale, at public auction, to the highest bidder for cash at the usual place of sale at the GASTON COUNTY COURTHOUSE- 325 Dr. Martin Luther King Jr. Way Gastonia, North Carolina 28052 on April 15, 2026 at 1:15 p.m. that certain parcel of land, including improvements thereon, situated, lying and being in the County of Gaston, State of North Carolina, and being more particularly described as follows:
All that certain lot or parcel of land situated in Cherryville Township, Gaston County, North Carolina and more particularly described as follows: Located, lying, and being in Cherryville Township, County and State aforesaid, bounded now or formerly on the North by Paul Black, on the East and South by C.W. Coggins, and on the West by Tot Dellinger Road, more particularly described according to survey and plat of Hoke S. Heavner, Reg. Surveyor, dated January 8, 1969, as follows: Beginning at an iron pin the center of the pavement of Tot Dellinger Road, Southwest Corner of Paul Black and Concern Corner with C.W. Coggins, and runs thence with line of Paul Black N 80 deg. 30 min, E 131.0 feet to an iron stake; thence continuing with line of Paul Black S. 67 deg. 30 min. E 83.7 feet to an iron stake in line of Paul Black, a new corner with C.W. Coggins; thence with new line S. 13 deg. 15 min, E 53.4 feet to an iron stake, a new corner; thence a new line S 81 deg. 07 min. W. 200.0 feet to a point in the center of the pavement of Tot Dellinger Road, a new corner; thence with the center of said pavement N 13 deg. 15 min. W 93.0 feet to the beginning, the same being a part of and carved from the C.W. Coggins lands. Together with the improvement located thereon said property being located at 228 Tot Dellinger Road, Cherryville, North Carolina. Being the identical property conveyed to Affinity Capital, LLC on March 31, 2021 in Book 5213 Page 2442 of the Gaston County Registry. Being the identical property conveyed to Grantor by North Carolina General Warranty Deed and to be duly filed for recording in Gaston County Registry.

The terms of the sale are that the real property hereinbefore described will be sold to the highest bidder. The Commissioner reserves the right to require certified funds not to exceed the greater of five percent (5%) of the amount of the bid or Seven Hundred Fifty Dollars ($750.00). The successful bidder shall also be required to pay revenue stamps on the Commissioner's Deed, any Land Transfer Tax, and the tax required by N.C.G.S. Section 7A-308(a)(1) unless the person entitled to enforce the instrument is exempt from paying these sums.
The real property hereinabove described is being offered for sale "AS IS, WHERE IS" and will be sold subject to all superior liens, unpaid taxes, and special assessments. The Commissioner reserves the right to sell the real property either as a group or on an individual basis whichever will bring the highest bid(s). Other conditions will be announced at the sale. The sale will be held open for ten (10) days for upset bids as by law required.
If the Commissioner is unable to convey title to this property for any reason, the sole remedy of the purchaser is the return of the deposit. Reasons of such inability to convey include, but are not limited to, the filing of a bankruptcy petition prior to the confirmation of the sale and reinstatement of the loan without the knowledge of the Commissioner. If the validity of the sale is challenged by any party, the Commissioner, in its sole discretion, if he believes the challenge to have merit, may declare the sale to be void and return the deposit. The purchaser will have no further remedy.
An order for possession of the property may be issued pursuant to G.S. 1-339.29 against the party or parties to the proceeding in possession by the presiding judge or clerk of superior court of the county in which the property is sold.
